استفاده از لباس های تنگ و چسبان به عنوان پوشش از منظر فقه امامیه (مقاله پژوهشی حوزه)

چکیده
احکام پوشش یکی از احکام پرکاربرد و مهم در فقه است. مسئله مورد بررسی این نوشته این است که آیا پوشاندن بدن با لباس های تنگ و چسبان برای تحصیل ستر و پوشش واجب شرعی کفایت می کند یا اینکه باید حجم بدن نیز پوشانده شود؟ در شریعت اسلام، حجاب شرعی و پوشش مطلوب شارع، حاصل جمع چند قانون و حکم شرعی است و در صورتی می توان حکم به کفایت لباس تنگ و چسبان به عنوان پوشش شرعی نمود که تمام این الزامات شرعی رعایت شده باشد. در این نوشته دو الزام اولی پوشش یعنی ساتر بودن بدن برای مردان و زنان، و ستر زینت در زنان، و همچنین چهار عنوان ثانوی یعنی اعانه بر اثم، ترویج حرام، لباس شهرت و تشبیه به کفار بررسی و تبیین شده است که گرچه لباس های تنگ و چسبان ساتر بدن هستند و از این جهت پوشاندن حجم بدن لازم نیست؛ ولی ملاک ستر زینت در این لباس ها وجود ندارد. همچنین بر زنان و مردان لازم است در مواردی که پوشیدن لباس تنگ، موجب اشاعه حرام و ترغیب به آن محسوب شود و یا اینکه موجب اذلال و خواری شخص باشد و یا لباس شهرت محسوب شود و یا اینکه تشبیه به کفار به حساب آید، از پوشیدن آن خودداری نماید. بله، اگر لباس های تنگ و چسبان، خالی از مفاسد فوق باشند؛ مانند پوشیدن جوراب و یا آستینچه، انتخاب این لباس ها برای پوشش اشکالی ندارند.The Use of Tight and Clinging Clothes as a Covering from the Perspective of Imami Jurisprudence
The rulings on covering are one of the most widely used and important rulings in jurisprudence. The issue examined in this article is whether covering the body with tight and clinging clothing is sufficient to achieve the obligatory religious veil or whether the bulk of the body must also be covered? In Islamic law, the religious hijab and the desired clothing of the owner of the sharia are the result of the sum of several religious laws and rulings, and a ruling can be made that tight and clinging clothing is sufficient as religious clothing if all of these religious requirements are met. This article examines and explains the first two requirements of clothing, namely covering the body for men and women, and covering the adornment of women, as well as four secondary topics, namely aiding in sin, promoting the forbidden, clothing of fame, and likening oneself to the infidels. Although tight and clinging clothing covers the body, and therefore it is not necessary to cover the body's bulk, there is no covering the adornment by these clothes. It is also necessary for women and men to refrain from wearing tight clothing in cases where wearing it is considered to spread or encourage something forbidden, or to humiliate a person, or to be considered a dress of fame, or to be considered to be likened to infidels. Yes, if tight and clingy clothes are free from the above-mentioned corruptions; such as wearing socks or sleeves, there is no problem in choosing these clothes for covering.
