چکیده
از آنجایی که مد متواضع و پوشش محجوب در بین کشورهای اسلامی، روز به روز در حال پیشرفت است؛ افراد بسیاری این پوشش را پوشش اسلامی می دانند و نادانسته و به غلط از آن پیروی می کنند. در طرف دیگر، عده ای به دنبال اثبات این نکته هستند که اصلا دین در مورد مسئله پوشش، جز در مواردی مانند پوشش برای نماز، احکام نگاه و حجاب زنان برای حضور در اجتماع، نظر خاصی ندارد. نکته بسیار مهم در این بحث آنست که: هر چند لزوما کلیت مادست برخلاف تعالیم عفاف و حجاب نیست؛ اما برای مورد قبول بودن از جانب دین، باید نکات ریزی در آن رعایت شود. برای استخراج حکم دین در این گونه موارد، نمی توان هر عنوان را جداگانه متعلق فتوا قرار داد؛ بلکه باید مجموع این امور در فرایند حکم مورد بررسی و دقت قرار گیرند. در این مقاله با استفاده از روش تحلیلی توصیفی سعی بر آن است که ابتدا نوع نگرش پیامبر9 و حضرات معصومین: به مسئله لباس و پوشش به درستی نشان داده شود و سپس چگونگی مواجهه فقیهان با مسائلی از این دست تبیین شود تا مشخص شود که مسئله پوشش و لباس به لحاظ کارکردهای مختلف و متفاوتش به عنوان یکی از مسائل مهم فقه در عرصه فرهنگ به شمار می رود.Covering Fashion, Jurisprudential Issue with Emphasis on Conceptual Clothing Function
As covering fashion among Islamic countries is progressively advancing, many people consider this covering as Islamic dress and unknowingly follow it incorrectly. On the other hand, some seek to prove that religion has no specific opinion about clothing except in cases such as covering for prayer, rules of looking, and women's hijab for social presence. A very important point in this discussion is that: although fashion is not necessarily against the teachings of modesty and hijab, certain details must be observed for it to be acceptable from a religious perspective. To extract religious ruling in such cases, each title cannot be separately subjected to fatwa; rather, all these matters must be examined and considered carefully in the ruling process. This article, using analytical-descriptive method, attempts to first properly show the Prophet's (PBUH) and Infallible Imams' (AS) perspective on clothing and covering, and then explain how jurists deal with such issues to demonstrate that the matter of clothing and dress, due to its various and different functions, is considered one of the important issues of jurisprudence in the cultural domain.
