چکیده
تغذیه کودک با شیر مادر تا آن اندازه حائز اهمیت است که از آن به مثابه یک حق یاد شده است. در قرآن و روایات اسلامی به تغذیه کودک با شیر مادر و اهمیت آن پرداخته شده است. اگرچه جامعه بین المللی و به ویژه نهادهای حقوق بشری، از تغذیه با شیر مادر به عنوان یک حق یاد می کنند، اما تغذیه با شیر مادر، چه به عنوان حق کودک و چه به عنوان حق مادر در هیچ سند حقوقی الزام آور، آن چنان که باید و شاید، نظم و نسق نیافته است. بررسی این حق بشری، نشان از آن دارد که اسلام، پیش تر با قدرت الزام آوری بیشتر، به آن پرداخته که در قرآن به عنوان منبع اصیل اسلامی، نیز به آن اشاره شده است. نوشتار پیشِ رو بر آن شده است تا از رهگذر تدقیق در حقوق اسلام و حقوق بین الملل به ایضاح حق تغذیه کودک با شیر مادر بپردازد. سطور پیشِ رو دریافته است که رویکرد حمایتی حقوق اسلام به مراتب، مترقیانه تر از آن چیزی است که در حقوق بین الملل آمده و به حق، ضروری است که حقوق بین الملل از گزاره های اسلامی بهره جوید و وام بگیرد. امری که نه تنها به توسعه حقوق بین الملل کمک می کند که موجب ترویج اندیشه اسلامی می شود.A Comparative Study of the Right to Breastfeed a Child in Islamic Law and International Law: The Richness of Islamic Law and the Progressive Development of International Law
Breastfeeding is of such importance that it is referred to as a right. The Quran and Islamic traditions have addressed breastfeeding and its importance. Although the international community, and especially human rights institutions, mention breastfeeding as a right, breastfeeding, whether as a child's right or as a mother's right, has not been regulated in any binding legal document as it should be and perhaps should be. A study of this human right shows that Islam has addressed it earlier, with greater binding power, and it has also been referred to in the Quran as the original Islamic source. The following article aims to clarify the right to breastfeed a child by examining Islamic and international law. The preceding lines have found that the protective approach of Islamic law is far more progressive than that found in international law, and it is rightly necessary for international law to benefit from and borrow from Islamic propositions. This not only helps in the development of international law but also promotes Islamic thought.
