تضمین کرامت انسانی در فرایند قضایی در نظام حقوقی ایران (مقاله علمی وزارت علوم)

چکیده
کرامت انسان از مهم ترین حقوق انسان و مورد توجه نظام های حقوقی در عصر حاضر به شمار می رود. رعایت این حق صرفاً نباید به عنوان یک توصیه اخلاقی در نظر گرفته شود، بلکه نظام های حقوقی می بایست نسبت به استیفای این حق در عرصه اجتماع و در مواقع مواجه شدن با چالش ها، تضمین هایی را قرار داده تا حفظ و رعایت کرامت انسان در عمل محقق شود. کرامت انسانی افراد با قرارگرفتن در فرآیند قضایی از شروع تا پایان نیازمند صیانت و تضمین است. در نظام حقوقی ایران تضمین هایی جهت رعایت کرامت انسانی افراد و حقوق ناشی از این کرامت در فرآیند قضایی پیش بینی شده است که می بایست مورد توجه قرار گیرد. تضمین های مذکور با تأکید بر حقوق افراد، موجب می شود هریک از مقامات و مسؤولین اعم از مقامات قضایی و ضابطین درصورت نادیده گرفتن حق کرامت انسانی مورد تعقیب کیفری یا انتظامی قرار گیرند. در این مقاله با روش توصیفی - تحلیلی به موضوع تضمین کرامت انسانی در فرآیند قضایی در نظام حقوقی ایران پرداخته و به این نتیجه می رسد که اولاً قوانین موضوعه در ایران دربردارنده مؤلفه های تضمین کرامت انسانی در فرآیند قضایی است؛ ثانیاً این تضمین ها صرفاً مخصوص متهم و محکومین نمی باشد و نسبت به سایر افرادی که در فرآیند قضایی نقش دارند، مؤلفه های تضمین کرامت انسانی وجود دارد که می توان به مؤلفه های تضمین کرامت انسانی قاضی اشاره نمود؛ ثالثاً در مواردی به دلیل وجود خلأهای قانونی، نیاز به وضع قوانین جدید و ایجاد سازوکارهای اجرایی جهت تضمین کرامت انسانی افراد در فرآیند قضایی وجود دارد.Guaranteeing Human Dignity in the Judicial Process in Iran's Legal System
Human dignity is one of the most important human rights and is considered by the legal systems in the current era. Compliance with this right should not be considered as a moral recommendation, but legal systems should provide guarantees regarding the fulfillment of this right in the social arena and when facing challenges in order to preserve and respect human dignity in the researcher's practice. to be The human dignity of people needs to be protected and guaranteed by being in the judicial process from the beginning to the end. In the legal system of Iran, there are guarantees to respect the human dignity of individuals and the rights arising from this dignity in the judicial process, which should be taken into consideration. The aforementioned guarantees, emphasizing the rights of individuals, cause any officials and officials, including judicial authorities and law enforcement officers, to be prosecuted criminally or disciplinary if they ignore the right to human dignity. In this article, the current research deals with the issue of guaranteeing human dignity in the legal process of Iran's legal system with a descriptive-analytical method and comes to the conclusion that; First, the laws in Iran include the components of guaranteeing human dignity in the judicial process. Secondly, these guarantees are not only for the accused and the convicted, and there are components of guaranteeing human dignity in relation to other people who play a role in the judicial process. Thirdly, in some cases, due to the existence of legal loopholes, there is a need to enact new laws and create executive mechanisms to guarantee the human dignity of individuals in the judicial process
