چکیده
در دهه های اخیر، استفاده از دوربین های مدار بسته به عنوان ابزاری فناورانه در فرآیند رسیدگی کیفری، نقش فزاینده ای در کشف جرم، شناسایی مرتکبین و ارائه ادله ایفا کرده است. این ابزار نظارتی، با ثبت وقایع به صورت عینی، به مقام های قضایی و ضابطین دادگستری امکان می دهد تا با استناد به شواهد تصویری، تصمیماتی مستندتر و دقیق تر اتخاذ کنند. به ویژه در جرایم مشهود، تصاویر ضبط شده می توانند به کاهش خطای انسانی در تشخیص بزهکار، تسریع در روند رسیدگی و تقویت صحت تحقیقات مقدماتی کمک کنند.با این حال، بهره گیری از این فناوری در بستر عدالت کیفری، چالش هایی نیز در پی دارد. از جمله نگرانی هایی در خصوص حفظ حریم خصوصی، امکان سوءاستفاده از تصاویر، و خطر جایگزینی قضاوت انسانی با شواهد فنی صرف. در این مقاله، ضمن بررسی مزایا و معایب کاربرد دوربین های مداربسته در نظام عدالت کیفری، تلاش می شود توازن میان کارآمدی فرآیند رسیدگی کیفری و صیانت از حقوق متهمان و اصول دادرسی منصفانه مورد تحلیل قرار گیرد. نتیجه گیری مقاله بر آن است که استفاده هدفمند و ضابطه مند از فناوری نظارتی، می تواند در راستای تحقق عدالت کیفری مؤثر واقع شود.The use of CCTV cameras in the criminal investigation process and its relationship to criminal justice
In recent decades, the use of CCTV as a technological tool in the criminal justice process has played an increasing role in detecting crimes, identifying perpetrators, and providing evidence. By objectively recording events, this surveillance tool allows judicial authorities and judicial officers to make more documented and accurate decisions based on visual evidence. Especially in obvious crimes, recorded images can help reduce human error in identifying criminals, speed up the investigation process, and enhance the accuracy of preliminary investigations. However, the use of this technology in the context of criminal justice also poses challenges. These include concerns about privacy, the possibility of misuse of images, and the risk of replacing human judgment with mere technical evidence. In this article, while examining the advantages and disadvantages of using CCTV in the criminal justice system, an attempt is made to analyze the balance between the efficiency of the criminal investigation process and the protection of the rights of the accused and the principles of fair trial. The conclusion of the article is that the targeted and disciplined use of surveillance technology can be effective in achieving criminal justice.
