کارآمدی هوش مصنوعی در سلامت تحت لولی قواعد بین المللی از منظر کاربردها و حدود حقوقی

چکیده
حقوق سلامت به معنای تامین شرایط لازم برای تحقق سلامتی افراد جامعه بوده و هدف آن حمایت و حفاظت از بشر در مقابل خطرات ناشی از محیط زیست می باشد. هوش مصنوعی در حوزه پزشکی و سلامت، به عنوان یکی از پرکاربردترین و مهمترین فناوری های دنیای امروز، به طور گسترده ای استفاده می شود. با توجه به پیشرفت روز افزون تکنولوژی و نیاز رو به افزایش جامعه به خدمات بهداشتی و درمانی، استفاده از هوش مصنوعی در حوزه پزشکی و سلامت، به عنوان یک راه حل موثر و دقیق در پردازش و استحصال نتایج برای بهبود کیفیت خدمات بهداشتی و درمانی، بسیار مهم و حیاتی است. البته اگر فعالیت اینگونه سیستم ها تحت ضوابط و مقررات الزام آور جهان شمول قرار نگیرد ممکن است در تمامی حوزه ها از جمله در عرصه حقوق سلامت نیز مخرب و تهدید آمیز باشد. به همین منظور دولت ها با درنظر گرفتن این امر مهم، تکنولوژی های نوظهور، از جمله هوش مصنوعی را به طور چشمگیری در حوزه های مختلف زندگی انسانی وارد نموده اند تا بتوانند از چنین پتانسیلی در جهت الگوهای دقیق علمی برای سلامتی انسان بهره گیرند. یکی از حوزه هایی که هوش مصنوعی تأثیر قابل توجهی دارد، حوزه پزشکی و سلامت و مدیا طب تجهیز است. از تشخیص بیماری ها تا پیش بینی نتایج درمانی، هوش مصنوعی در این حوزه انقلابی را رقم زده است. این تکنولوژی نوآورانه امکاناتی را به دسترس پزشکان و حوزه سلامت می آورد که تاثیرات عمده ای را در تشخیص، درمان و مدیریت بیماری ها دارد. به همین منظور با درنظرداشت حائز اهمیت بودن این مسئله، جستار کنونی مقوله کارآمدی هوش مصنوعی در سلامت تحت لوای قواعد بین الملل از منظر کاربردها و حدود حقوقی را در قالب مطالعات کتابخانه ای و به شیوه تحلیلی-توصیفی در بوته نقد و بررسی قرار داده است. یافته های حاصل از پژوهش بیانگر آن است که هوش مصنوعی می بایست در خدمت سلامت جامعه در قالب یک دستیار و ابزار نوین و کارآمد باشد تا بتوان ذیل این مسئله، اعتلای حق بر سلامت افراد را تأمین نمود.The effectiveness of artificial intelligence in health under the framework of international rules from the perspective of applications and legal limits

Artificial intelligence in the field of medicine and health, as one of the most widely used and important technologies in today's world, is widely used. Given the increasing progress of technology and the increasing need of society for health and medical services, the use of artificial intelligence in the field of medicine and health, as an effective and accurate solution in processing and extracting results to improve the quality of health and medical services, is very important and vital. Of course, if the activities of such systems are not subject to binding global rules and regulations, they may be destructive and threatening in all areas, including the field of health rights. For this reason, governments, taking this important matter into account, have significantly introduced emerging technologies, including artificial intelligence, into various areas of human life in order to be able to use such potential for accurate scientific models for human health. One of the areas where artificial intelligence has a significant impact is the field of medicine and health and medical equipment. From diagnosing diseases to predicting treatment outcomes, artificial intelligence has revolutionized this field. This innovative technology provides doctors and the health sector with facilities that have major impacts on the diagnosis, treatment, and management of diseases. For this reason, considering the importance of this issue, the current research has reviewed and evaluated the effectiveness of artificial intelligence in health under international rules from the perspective of applications and legal limits in the form of library studies and in an analytical-descriptive manner. The findings of the research indicate that artificial intelligence should serve the health of society in the form of a new and efficient assistant and tool so that the right to health of individuals can be ensured under this issue.
