چکیده
حقوق طبیعی و مدنی افراد دارای معلولیت به عنوان یکی از اقلیت های بزرگ که بالغ بر یک دهم جمعیت جهان را تشکیل می دهند ، شامل یک پارادایم اساسی از حقوق بشر است که منعکس کننده کرامت و برابری ذاتی همه افراد است. حقوق فطری و مدنی معلولین به مجموعه ای از حقوق و مزایایی اشاره دارد که به دلیل شرایط خاص این افراد، از اهمیت ویژه ای برخوردار است. حقوق فطری، به حقوقی اشاره دارد که به طور طبیعی و ذاتی به هر انسان تعلق دارد و شامل حق زندگی، حق آزادی، و حق برخورداری از کرامت انسانی می شود. از سوی دیگر، حقوق مدنی، به حقوقی اشاره دارد که به وسیله قوانین و مقررات اجتماعی تعیین می شوند و شامل حق آموزش، حق کار، حق دسترسی به خدمات عمومی و حق مشارکت در زندگی اجتماعی است. تحقیق در مورد حقوق فطری و مدنی معلولین نشان می دهد که این گروه از افراد با چالش های خاصی مواجه هستند که نیاز به توجه و حمایت ویژه دارد. بسیاری از کشورها به منظور تضمین حقوق معلولین، قوانین و مقررات خاصی را وضع کرده اند، اما در عمل، هنوز هم موانع زیادی وجود دارد که بر سر راه تحقق کامل این حقوق قرار دارد. این مقاله به بررسی ابعاد مختلف حقوق فطری و مدنی معلولین، و همینطور بررسی قوانین بین المللی موجود در این راستا می پردازد و اهمیت ایجاد یک جامعه فراگیر و برابر را مورد تأکید قرار می دهد.An international-philosophical study of the natural and civil rights of people with disabilities
The natural and civil rights of persons with disabilities, as one of the largest minorities that make up more than one tenth of the world’s population, comprise a fundamental paradigm of human rights that reflects the inherent dignity and equality of all individuals. The natural and civil rights of persons with disabilities refer to a set of rights and benefits that are of particular importance due to their specific circumstances. Natural rights refer to rights that are naturally and inherently inherent to every human being and include the right to life, the right to liberty, and the right to human dignity. Civil rights, on the other hand, refer to rights that are determined by social laws and regulations and include the right to education, the right to work, the right to access public services, and the right to participate in social life. Research on the natural and civil rights of persons with disabilities shows that this group of individuals faces specific challenges that require special attention and support. Many countries have enacted specific laws and regulations to guarantee the rights of persons with disabilities, but in practice, there are still many obstacles to the full realization of these rights. This article examines various aspects of the natural and civil rights of people with disabilities, as well as the existing international laws in this regard, and emphasizes the importance of creating an inclusive and equal society.
