پیشگیری از تکرار جرم و بازپروری بزهکاران با تأکید بر اندیشه رهبر معظم انقلاب اسلامی

چکیده
تکرار جرم به عنوان یکی از مظاهر حالت خطرناک، جوامع مختلف را به موضع گیری های متنوعی واداشته است. سنتی ترین پاسخ در قبال این پدیده ناخوشایند توسل به شدت کیفرهاست. نظر به اینکه بخشی از بزهکاران بعد از تحمل مجازات دوباره مرتکب جرم می شوند، برخورد صحیح و اصولی با آنها و جلوگیری از تکرار جرم، تأثیر به سزائی در تأمین بخش مهمی از امنیت جامعه دارد. طبیعی است که در صورت عدم برخورد صحیح با بزهکاران، نه تنها هدف اصلاح بزهکاران تأمین نمی شود، بلکه زمینه های تکرار جرم توسط آنها نیز مهیا خواهد شد. از سویی بازپروری یا اصلاح و درمان بزهکار از تاسیس هایی می باشد که در واکنش به جرم قابلیت استفاده دارد و می تواند نظام عدالت کیفری را در رسیدن به اهداف خود یاری کند که یکی از آنها پیشگیری از تکرار جرم است و از دگر سو بازخوانی سخنان رهبر معظم انقلاب اسلامی ایران به عنوان کسی که جایگاه راهبردی در سپهر سیاست جنایی ایران دارد اهمیتی دو چندان دارد. از این رو در این پژوهش به پیشگیری از تکرار جرم و اصلاح بزهکاران با تأکید بر سخنان رهبری با استفاده از روش تحلیلی و توصیفی در فیش های سخنان معظم له پرداخته شده است. برآیند حاصل از پژوهش این بوده است که سرعت، دقت و یکسان اجرایی عدالت در قالب کیفر و هنجارسازی فرهنگی و آگاهی بخشی در اقدامات نرم در پیشگیری از جرم تأثیر گذار است. همچنان که تشویق قانون مداران و اصلاح ذات البین و گذشت از بزهکاران در بازپروری بزهکاران نقش آفرین است.Preventing Recidivism and Rehabilitating Offenders with a Focus on the Ideas of the Supreme Leader of Iran
Repeat crimes, or recidivism, as a form of risky behavior, have led to different reactions in various societies. The most common response to this issue has been increasing punishments. However, since some offenders commit crimes again after serving their sentences, properly managing these individuals is crucial for maintaining public safety. If offenders are not handled effectively, not only will they not reform, but they may also commit crimes again. Rehabilitation and treatment of offenders are key approaches to dealing with crime. These methods help the justice system achieve its goals, especially in preventing repeat offenses. Additionally, reviewing the views of the Supreme Leader of Iran-who plays an important role in shaping the country’s criminal policies-adds great value to this discussion. This study examines ways to prevent repeat crimes and rehabilitate offenders, with a focus on the Leader’s ideas. It uses an analytical and descriptive approach to review his documented speeches. The findings show that quick, fair, and consistent enforcement of justice, combined with promoting cultural values and raising awareness, can significantly prevent crime. Likewise, encouraging law-abiding behavior, promoting reconciliation, and showing forgiveness to offenders are important for their rehabilitation.
