چکیده
هدف از پژوهش، شناسایی مسائل و نیازهای مختلف کودکان همراه با مادران زندانی و انطباق آن ها با قوانین و اسناد داخلی و بین المللی حقوق کودک است. پژوهش در دو گام با رویکرد کیفی و روش تحلیل محتوای کیفی انجام شده است. در گام اول، برای شناسایی حقوق کودک چهار قانون و سند داخلی و سه قانون بین المللی تحلیل شده اند. در گام دوم، 32 متن شامل مصاحبه ، گزارش و تجربه های زیسته مرتبط با کودک همراه با مادر زندانی در ایران که در خبرگزاری های داخلی و خارجی، روزنامه ها و پایگاه های اطلاعاتی منشر شده بودند همراه با هشت مطلب منتشر شده در صفحه شخصی اینستاگرام یکی از فعالان حقوق کودک، تحلیل شده اند. نتایج تحلیل داده ها نشان داد به کودکان همراه با مادران زندانی در قوانین و اسناد داخلی و بین المللی کمتر توجه شده است. شرایط و امکانات مناسبی برای کودکان در زندان های ایران وجود ندارد. به دلیل شرایط و امکانات حداقلی در زندان، محیط امنیتی آن و نگهداری کودک با دیگر زندانیان، زندان محیط مناسبی برای نگهداری کودک نیست. بهتر است کودک همراه با مادر در موسسه های شبیه خانه دور از محیط زندان نگهداری شوند تا تعامل بهتری با مادر ایجاد نموده و نیازهای دوران کودکی وی همچون بازی، آموزش و یادگیری تامین گردد.Analyzing the rights of the child along with the imprisoned mother in laws and documents and explaining his needs and problems in Iranian prisons
The research purpose is to identify the various issues and needs of children with imprisoned mothers and their compliance with domestic and international laws related to children's rights. The research was done in two steps with qualitative approach and qualitative content analysis method. In the first step, four domestic laws and documents and three international laws have been analyzed to identify children's rights. In the second step, 32 texts including interviews, reports and lived experiences related to a child with a mother imprisoned in Iran, which were published in domestic and foreign news agencies, newspapers and databases, along with eight contents published on the personal Instagram page of one of Child rights activists have been analyzed. The results of the data analysis showed that children with imprisoned mothers have received less attention in domestic and international laws. There are no suitable conditions and facilities for children in Iran's prisons. Due to the minimum conditions and facilities in the prison, its security environment and keeping the child with other prisoners, the prison is not a suitable environment for keeping the child. It is better to keep the child together with the mother in home-like institutions away from the prison environment.
