چکیده
زمینه و هدف: مسؤولیت حقوقی افراد مبتلا به اختلالات شخصیت، مسئله ای پیچیده است که باید به بررسی معیارهای مورد استفاده برای ارزیابی مسؤولیت حقوقی افراد مبتلا به اختلالات شخصیت، با در نظر گرفتن دیدگاه های مختلف حقوقی و روان شناسی قانونی پرداخت. مواد و روش ها: این مطالعه به صورت تحلیلی-توصیفی انجام شده است. ملاحظات اخلاقی: تمامی اصول اخلاقی در نگارش این مقاله رعایت شده است. یافته ها و نتیجه گیری: یافته های پژوهش بیانگر آن است که در حوزه حقوق خصوصی، ابتلای فرد به اختلال شخصیت می تواند بر اعتبار اراده و اهلیت او در انجام معاملات و اعمال حقوقی تأثیر گذار باشد. چنانچه این اختلال، توانایی درک ماهیت یا پیامد اعمال حقوقی را به طور قابل توجهی مختل کند می توان موجبات بطلان یا قابلیت فسخ قرارداد را فراهم دانست. افزون بر این عوامل اجتماعی و برچسب های روانی ممکن است بر نحوه قضاوت دادگاه در تعیین میزان مسؤولیت مدنی فرد اثرگذار باشند. در نتیجه ارزیابی روان شناختی دقیق، نقش اساسی در احراز صحت اراده و مسؤولیت مدنی اشخاص مبتلا به اختلال شخصیت دارد.A Legal-Psychological Analysis of the Criteria for Liability in Individuals with Personality Disorders
Background and Aim: The legal liability of individuals diagnosed with personality disorders presents a complex issue that necessitates an examination of the criteria employed to assess such liability, incorporating diverse perspectives from legal theory and forensic psychology.
Materials and Methods: This study was conducted using an analytical-descriptive approach.
Ethical Considerations: All ethical principles have been followed in writing this article.
Findings & Conclusion: The findings indicate that in the realm of private law, the presence of a personality disorder may significantly affect the validity of intent and legal capacity in executing contracts and legal acts. If the disorder substantially impairs the individual's ability to comprehend the nature or consequences of legal actions, it may constitute grounds for nullification or rescission of the contract. Furthermore, social factors and psychological labeling may influence judicial assessments regarding the extent of civil liability. Therefore, comprehensive psychological evaluation plays a pivotal role in determining the authenticity of intent and the civil responsibility of individuals with personality disorders.
