چکیده
پیش بینی حبس در نظام کیفری جمهوری اسلامی ایران تنها جنبه سزادهی ندارد و اهداف اصلاحی نیز بر آن مترتب است. اهتمام تدوین کنندگان آیین نامه اخیر بر این بوده است تا با فراهم ساختن بستر قانونی مطلوب مسیر اصلاح و بازگشت زندانی به جامعه را هموار سازند، لذا این آیین نامه واجد نوآوری های متعددی است که پیش بینی بهره مندی از ظرفیت گروه های جهادی، تشکل های مردم نهاد و کارآفرینان در تمام ابعاد اصلاح و تربیت و اشتغال و حرفه آموزی مددجویان، ارتقای کیفیت طبقه بندی زندانیان، پیش بینی مقررات مطابق با استانداردهای جهانی برای مددجویان طیف سنی نوجوانان از این جمله می باشند، اما متأسفانه باید گفت در مواردی نیز با مشکلات و چالش هایی روبه رو می باشد، ازجمله عدم تصویب یک قانون در حوزه مدیریت زندان ها و حقوق زندانیان، عدم سازگاری محیط زندان ها با آیین نامه، عدم کاربردی بودن شیوه طرح، تشکیل و انتخاب اعضای شورای طبقه بندی که این چالش ها مانع از تحقق هدف اصلی زندان که همان اصلاح و تربیت و بازپروری مجرمان می باشد، گردیده است. امروزه از طرفی شاهد نقض حقوق زندانیان در زندان ها هستیم و از طرفی دیگر تورم در جمعیت زندانیان با اشباع زندان ها، سوءتغذیه، نبود مراقبت های پزشکی، شیوه بیماری های واگیردار و عفونی، فساد رفتاری، شیوع بیماری های ویروسی سلامت جسمی و روحی ایشان را در خطر قرار داده است. باید تأکید نمود فقدان پرسنل آموزش دیده، مجرب و متخصص و نبود منابع مالی کافی در زندان ها و نیز عدم اجرای صحیح قوانین، نبود نظارت های لازم، منجر به عدم اجرای عدالت و تضییع حقوق این گروه از جامعه می گردد.Features, Innovations and Challenges of the Bylaws of the Prisons Organization and Security and Educational Measures of the Country Approved in 2021
The provision of imprisonment in the penal system of the Islamic Republic of Iran not only has a punitive aspect but also has reformative goals. The efforts of the compilers of the recent regulations have been to pave the way for the correction and reintegration of prisoners into society by creating a favorable legal framework. Therefore, these regulations have several innovations that foresee benefiting from the capacity of jihadi groups, NGOs and entrepreneurs in all dimensions of correction, education, job training and vocational training of clients. Improving the quality of prisoner classification and providing regulations in accordance with international standards for teenagers seeking help are among these innovations. However, it must be said that, unfortunately, it also faces problems and challenges in some cases. Including the non-approval of a law in the field of prison management and prisoners' rights, the incompatibility of the prison environment with regulations, the lack of applicability of the planning method and the formation and selection of classification council members, these challenges prevent the realization of the main goal of the prison, which is reformation and rehabilitation of criminals. Today, on the one hand, we are witnessing the violation of prisoners' rights in prisons and on the other hand, there is an increase in the population of prisoners due to overcrowding, malnutrition, lack of medical care, the spread of contagious and infectious diseases, behavioral corruption, the prevalence of viral diseases and compromised physical health, which endangers their morale. It should be emphasized that the lack of trained, experienced and expert personnel, the lack of financial resources in prisons, as well as the lack of proper implementation of laws and necessary supervision, lead to the absence of justice and the violation of the rights of this group of people.
