فناوری هوش مصنوعی در محاکم با تأکید بر مراجع اختصاصی اداری: چشم انداز و چالش ها (مقاله علمی وزارت علوم)

چکیده
در عصر جدید که فناوری هوش مصنوعی در بسیاری از ابعاد زندگی اجتماعی حکمفرماست، شواهد فزاینده ای وجود دارد که نشان می دهد هوش مصنوعی ممکن است به زودی جایگزین وظایف مهم دادگاه شود. چشم انداز معرفی فناوری های هوش مصنوعی در دادرسی اداری، بررسی برخی چالش ها و همچنین تعیین فرصت هایی که چنین فناوری هایی برای بهبود حمایت از حقوق، آزادی ها و منافع اشخاص حقیقی و حقوقی در روابط حقوقی ایجاد می کنند، حائز اهمیت است. این مقاله با شیوه توصیفی، تحلیلی در پی پاسخ به این پرسش است که چشم انداز استفاده از فناوری هوش مصنوعی چیست و با چه چالش هایی مواجه است. بر اساس تجزیه و تحلیل مقاله، یافته های پژوهش حاکی از آن است که با لحاظ وجود برخی چالش ها در بهره گیری از این فناوری، ضرورت عقلی ایجاب می نماید در ابتدای مسیر طیف محدودتری از محاکم با تاکید بر دادگاه های اختصاصی اداری از این فناوری استفاده کنند؛ فناوری هوش مصنوعی علی رغم وجود برخی معایب نظیر عدم عقلانیت و درک واقعی موضوعات حقوقی و نقض برخی جنبه های حقوق بشر، باید برای به ارمغان آوردن مزایای قابل توجهی نظیر جلوگیری از صدور آرای متناقض، تضمین استقلال مراجع اختصاصی اداری، توصیه و ارشاد افراد در طرح دعوا، اعمال نظارت مستقل و یکپارچگی اجرای احکام مراجع اختصاصی مورد استقبال قرار گیرد.Artificial intelligence in courts with an emphasis on dedicated administrative authorities
In the new age where artificial intelligence technology dominates many aspects of social life, there is growing evidence that artificial intelligence may soon replace important court functions. The prospect of introducing artificial intelligence technologies in administrative proceedings, examining some challenges and also determining the opportunities that such technologies create to improve the protection of the rights, freedoms and interests of natural and legal persons in legal relations is important. This article, with a descriptive and analytical method, seeks to answer the question of what is the prospect of using artificial intelligence technology and what challenges it faces. Based on the analysis of the article, the findings of the research indicate that in view of the existence of some challenges in using this technology, rational necessity requires that a limited range of courts, with an emphasis on dedicated administrative courts, use this technology at the beginning of the path; Artificial intelligence technology, despite the existence of some disadvantages such as the lack of rationality and real understanding of legal issues and the violation of some aspects of human rights, should be used to bring significant benefits such as preventing the issuance of contradictory votes, guaranteeing the independence of dedicated administrative authorities, advising and guiding people in Lawsuits, independent supervision and integrity of the execution of special authority orders should be welcomed.
