چکیده
از جمله موضوعات مهمی که در قانون کارجمهوری اسلامی ایران جلب توجه می نماید، نحوه، تعیین حداقل مزد می باشد. علت اصلی توجه مقنن به مزد کارگران را می توان در این واقعیت اجتماعی دانست که قانونگذار باید به حمایت از طرف ضعیف رابطه یعنی کارگر پرداخته و وی را در مقابل کارفرما که هم دارای ثروت و قدرت اجتماعی است. پاسداری نماید. در نظام حقوقی ایران، مزد کارگر و نحوه تعیین آن از جمله موضوعات مهمی است که قانونگذار توجه ویژه ای به آن داشته است که یکی از آسیب های تعیین حداقل مزد که به صورت یک سنت اشتباه در شورای عالی کار اجرا می شود، یکسان بودن ضوابط تعیین مزد برای تمامی گروه های سنی، تمامی مناطق مختلف و تمامی بنگاهاست. ضرورت ایجاب می کند با بهره گیری ازویژگی های انعطاف پذیری قانون کارکه درمواد 191,190,189پذیرفته شده است، راه حل مناسبی جهت ایجاد اشتغال و با لحاظ حفظ حقوق کارگران و تامین منافع کارفرمایان وتشویق سرمایه گذاری، ضوابط متنوعی در تعیین مزد پیش بینی نمود. نویسندگان دراین مقاله به بررسی آسیب شناسی تعیین مزد کارگران وراهکارهای اصلاحی آن پرداخته اند. روش تحقیق در این پژوهش، توصیفی-تحلیلی است و در جمع آوری منابع از روش کتابخانه ای استفاده شده است.The pathology of workers' wage determination and its corrective measures with a look at the judicial practice of the Administrative Court of Justice

The research method in this study is descriptive-analytical, and the library method was used in collecting sources.
