چکیده
تفسیر متون وحیانی، نیازمند اتخاذ اهداف، مبانی، قواعد، و روش های خاصّی است که مطالعات روش شناختی تفسیر نامیده می شود و برآیند آنها به شکل گیری سنت های تفسیری مختلف می انجامد. نظریه حجیت یکی از این سنّت هاست. براساسِ این نظریه، دستیابی به مراد الهی در چارچوب برنامه رسیدن به «حجت شرعی» از راه اصول لفظیه و امارات شرعیه ممکن است که در آن باید از مبانی، ابزارها و روش های متداول فقهی در حوزه اعتبارسنجی قراین تفسیری بهره گرفت. این نظریه با بیان های مختلفی از منجزیت تا وسطیت و غیره مواجه است و بر اساس آن نیز دیدگاه های مختلفی درباره امکان پذیرش آن در تفسیر قرآن، مطرح می شود. نویسنده در این مقاله می کوشد ضمن نقد این دیدگاه ها و بیان دو اشکال مهم فقدان اثر شرعی و مغایرت با رسالت مفسر، فرایند اعتبارسنجی قراین فهم و تفسیر را خارج از فضای گفتمان این نظریه مطرح نماید.Appraising the Possibility of the “Theory of Jurisprudential Authority” in the Field of Interpretation
In order to interpret revealed texts, we require to adopt specific objectives, principles, rules, and methods that are known as the methodological studies of interpretation, and their resultant leads to the formation of various interpretive traditions; and of course, the theory of authority is one of these traditions. According to this theory, achieving the Divine Intention is within the framework of the plan for achieving “legal authority” through verbal principles and legal denotations ( im ā r ā t ), and based on it, the common principles, tools, and methods of jurisprudence should be utilized in the field of validating interpretive evidence. This theory has been confronted with various statements, from accomplishment ( munajjaziyyat ) to middleness ( wasa ṭ iyyat ), etc., according to which, different views are put forward regarding its possibility of acceptance in the interpretation of the Qur'an. This article is intended to critique these views and states two important problems, the lack of legal efficacy and the contradiction with the mission of the interpreter, and to propose the process of validating the evidence of understanding and interpretation outside the discourse atmosphere of this theory.
