نقش دولت در اعطای شخصیت حقوقی به ماهیات غیرانسانی: درآمدی نظری بر امکان اعطای شخصیت حقوقی به هوش مصنوعی

چکیده
یکی از چالش های مهم نظری در مسیر قانونی شدن هوش مصنوعی، شناسایی آن به عنوان یک شخص قانونی در عرض اشخاص حقیقی و حقوقی دیگر است. برای پاسخ گویی به بسیاری از سوالات حقوقی که در حوزه هوش مصنوعی وجود دارد، نیازمند آن هستیم که به پرسش درباره کیفیت اعطای شخصیت حقوقی به ماهیات غیر انسانی و در ادامه، به هوش مصنوعی و نیز نقش دولت در این اعطا، پاسخ مناسب دهیم. پژوهش حاضر با مطالعه اسناد کتابخانه ای و با شیوه توصیفی - تحلیلی به بررسی این موضوع پرداخته و بدین نتیجه رسیده است که در حقوق ایران، ماهیت شخصیت حقوقی، اعتباری و شیوه اعطای آن به ماهیات غیر انسانی از طریق قرارداد و اعتباربخشی دولت است. بدین معنا که در این مسیر، دولت با تعیین چهارچوب های قانونی و نیز از طریق اعمال نهاد ثبت، در تایید اراده اشخاص اعتبارکننده، در اعطای شخصیت حقوقی به ماهیات غیر انسانی ایفاگر نقش اصلی است. در نهایت، از آنجا که بر طبق مقررات و موازین فعلی حقوقی ایران، اعطای شخصیت حقوقی به ماهیات غیر انسانی تنها از مجرای پیش بینی و تایید قانونی میسور خواهد بود، با توجه به فقدان مقررات، فعلا زمینه برای اعطای شخصیت حقوقی به هوش مصنوعی –در حقوق ایران- مهیا نیست.The Role of Government in Granting Legal Personality to Non-Human Entities: An Introduction to the Legal Recognition of Artificial Intelligence
A major theoretical challenge in recognizing artificial intelligence (AI) as a legal entity is distinguishing it from natural and other legal persons. To address the various legal issues surrounding AI, it is important to explore the concept of granting legal personality to non-human entities and consider the role of the government in this process. This study, using a descriptive-analytical approach and a review of relevant literature, examines the issue and concludes that Iranian law acknowledges the nature of AI. The legal recognition of non-human entities may be achieved through contracts and government approval. In this process, the government can play a crucial role by establishing legal frameworks and utilizing registration mechanisms. However, due to the current lack of specific legal regulations, granting legal personality to AI under Iranian law is not yet feasible.
