چکیده
یکی از مهمترین چالشهای سیاست جنایی اغلب کشورها در عصر حاضر ، طراحی مکانیزمهایی برای ترمیم و جبران خسارات بزه دیدگان میباشد . بطور خاص بزه دیدگی در جرایم مرتبط با مواد مخدر از حیث گستردگی قلمرو آن دارای وجوه متعددی می باشد . ویژگی های مربوط به بزه دیده ، رابطه میان بزه دیده و بزهکار و ماهیت خاص مواد مخدر موجب حساسیت بیشتر موضوع بزه دیدگی در این جرایم و به طور خاص در صورت بزه دیدگی اطفال و نوجوانان و زنان در این حوزه می باشد . ارتباط پیچیده میان مصرف مواد مخدر و جرایم مرتبط با تامین مالی اعتیاد ، خسارات جسمی، روانی، اجتماعی ، عاطفی و هیجانی عمده ای را در پی دارد به نحویکه در صورت فقدان یک الگوی کارامد کنترلی و پیشگیرانه ، ترمیم و جبران خسارات بزه دیدگان با مشکل مواجه خواهد بود. وجود قوانین حمایتی و تامین بسترهای لازم برای به رسمیت شناختن حقوق بزه دیدگان این جرایم بدوا گام مهمی برای تدوین یک سیاست جنایی موثر است. در این مقاله بر آنیم تا به روش توصیفی – تحلیلی ضمن شناسایی مصادیق بزه دیدگی در جرایم مذکور به تحلیل اسناد مهم بین المللی مصوب در این زمینه نیز بپردازیم .Victimization in Drug Crimes with a Look at International Documents
One of the foremost challenges for contemporary criminal policy is designing effective mechanisms for victim reparation and compensation. Victimization in drug-related crimes is particularly multifaceted due to its extensive scope. Factors such as the victim's characteristics, the offender-victim relationship, and the unique nature of narcotics intensify the complexities of this issue, especially when vulnerable groups such as women, children, and adolescents are victimized. The intricate link between drug use and the crimes committed to finance addiction leads to significant physical, psychological, social, and emotional harm. In the absence of an effective prevention and control model, victim recovery and restitution are severely hindered. Enacting protective legislation and establishing frameworks that recognize the rights of these victims are critical first steps in developing a robust criminal policy. Using a descriptive-analytical method, this article identifies various forms of victimization in drug-related offenses and analyzes key international instruments designed to address the issue.
