چکیده
ازجمله چالش هایی که فقها به هنگام مواجهه با ادله شرعی با آن روبه رو می شوند این است که آیا حکم مذکور، اختصاص به همان موضوع مذکور در دلیل دارد یا در مورد موضوعات دیگری نیز جاری است؟ آیا حکم، تمام مصادیق موضوع خود را در بر می گیرد یا فقط برخی مصادیق آن را شامل می شود؟ یکی از مهم ترین قواعد استظهار از دلیل، تناسب حکم و موضوع وارد در دلیل است. سازگاری، هماهنگی و ملائمت عرفیه یا عقلیه بین حکم و موضوع که از ارتباط موضوع و حکم به دست می آید، مناسبت حکم و موضوع می گوید که می تواند توسعه یا تضییق در ناحیه مدلول دلیل نماید. از طرفی اسباب توسعه و تضییق، منحصر در این قرینه نیست و قراین دیگری همچون الغای خصوصیت، تنقیح مناط و... وجود دارد که باید به تمایز میان آن ها با تناسب حکم و موضوع پرداخت. عمل به این قرینه در میان فقهای شیعه و سنی رایج است. در این نوشتار سعی بر آن است ضمن تعریف، تبیین و ارائه ملاک این قرینه، تمایز آن با سایر اسباب توسعه و تضییق مشخص و اعتبار آن بررسی شود.Analyzing the Criterion for the Appropriateness of the Ruling and its Subject, and its Distinction from Other Causes of Expanding or Restricting Rulings
One of the challenges faced by jurists when dealing with legal proofs is whether the ruling mentioned in the legal evidence is for a specific case or if it also extends to other similar cases. One of the most important principles of inference ( ʾistiẓhār ) from legal evidence which is commonly practiced among both Shīʿī and Sunnī jurists is the appropriateness of the ruling and its subject. This principle refers to the customary or rational alignment, coherence, and congruence between the ruling and its subject, derived from their mutual relationship, and it can result in the expansion or restriction of the scope of a legal ruling. However, this principle is not the only criterion of the expansion or restriction of legal rulings. Other causes such as elimination of specificity ( ilghāʾ al-khuṣūṣiyyah) , refinement of rational ( tanqīḥ al-manāṭ ), etc. also exist, and must be distinguished from the appropriateness of the ruling and its subject. This study aims to define, explain, present the criterion of this indicator, and distinguish it from other causes of extension and restriction, eventually examining its validity.
