چکیده
تعدد معانی حقیقی یک لفظ را در علم منطق و اصول مشترک لفظی گویند که در مقابل مشترک معنوی از آن یاد می شود. در قانون اساسی برخی کلید واژگان از حیث لفظ مشترک و از حیث معنا و مفهوم، معانی متعددی را در بر می گیرند. فهم معنا و مفهوم دقیق واژگان مذکور برای جلوگیری از لوث مسئولیت ها و ممانعت از تداخل وظایف و کارکردها و موازی کاری نهادها به نحوی که به اتلاف سرمایه ها و ایجاد چالش های حقوقی منجر شود، مهم و ضروری است. بر این اساس در این مقاله به بررسی مفهوم دانشواژه دولت در قانون اساسی پرداخته شده است و از مجموع چهار دسته معانی دولت در این قانون به بررسی دو دسته از معنای آن اکتفا گردیده است. در این دو دسته از معانی دولت مفاهیم کشور و هیئت وزیران یا کابینه قابل مشاهده است. روش به کارگرفته در این مقاله برای پاسخ به سؤال اصلی این پژوهش درخصوص مفهوم دولت در قانون اساسی به صورت تحلیلی است. در مفهوم شناسی واژه دولت در قانون اساسی، فرضیه این پژوهش آن است که دانشواژه «دولت» در پنج اصل شامل اصول 11، 42، 125، 152 و 155 به معنای کشور به کار رفته است و در شش اصل شامل اصول 79، 102، 134، 135، 136 و 138 به معنای هیئت وزیران یا کابینه است.An Analysis of the Conceptual Fluctuation of "Government" within the Framework of Constitutional Principles: "Government" as "State" and "Cabinet/Council of Ministers
In the Constitution of the Islamic Republic of Iran, the term "government" has been used to express Four distinct concepts. Each of these concepts places the State in a special legal status, which, in order to identify the rights and duties of the State and the people in the Constitution, should be taken into account in the particular concept of government in each principle. If we do not define the government correctly in principles of the Constitution, it is possible that the principle in question is devoid of content or incompatible with the purposes of the Constitution. Therefore, the concept of government in each principle must be derived from the general principles and evidences used for regulating the said principle .Within the semantics of the word of government in the Constitution, the hypothesis of this research is that the university term of "government" has been used under the meaning of country in 5 principles, including the principles 11, 42, 125, 152 ,155 and in six other principles, including the principles 79, 102, 134, 135, 136 and 138, it means the cabinet.
