چکیده
حداقل سن مسؤولیت کیفری کودک از موضوعات مهم و محل بحث و اختلاف نظر است. همین امر بررسی حداقل سن مسؤولیت کیفری کودک را از منظر اسناد بین المللی به یک ضرورت مبدل ساخته است. بر همین اساس هدف مقاله حاضر بررسی الزامات دولت ها درخصوص حداقل سن مسؤولیت کیفری کودک است. این مقاله توصیفی تحلیلی است و از روش کتابخانه ای برای بررسی موضوع مورد اشاره استفاده شده است. یافته ها بر این امر دلالت دارد که در طول چندین دهه، مجموعه ای از اسناد حقوق بین الملل، بحث حداقل سن مسؤولیت کیفری و پیامدهای آن را در بسترهای منطقه ای و بین المللی مورد بررسی قرار داده اند. در اسناد مرتبط با حقوق بشر و قوانین بشردوستانه، در تاریخچه تهیه پیش نویس اسناد و متن نهایی آن ها در متون الزام آور و مشاوره ای بین المللی، الزامات قانونی برای حداقل سن مسؤولیت کیفری مورد توجه و تأکید قرار گرفته است. حداقل سن مسؤولیت کیفری با جزئیات حداقل سن مسؤولیت کیفری و اجرای آن به وضوح از کار کمیته حقوق کودک نشأت می گیرد. درحقیقت، کمیته، حداقل سن مسؤولیت کیفری را به صورت مشروح مورد بررسی قرار داد و به عنوان نهاد نظارت کننده بر گسترده ترین سند قانونی الزام آور مرتبط با کودکان، صلاحیت بیشتری به دست آورد. نتیجه این که توصیه های کمیته حقوق کودک تا حد زیادی و در طول زمان توسط سایر اسناد و نهادها مورد تأیید قرار گرفته اند و یک همگرایی کلی در استانداردهای بین المللی برای تعیین حداقل سن مسؤولیت کیفری در کشورهای مختلف و اجرای آن ها را پیشنهاد می کنند.Government Requirements Regarding the Minimum Age of Criminal Responsibility of a Child from the Point of View of International and Regional Documents
The minimum age of criminal responsibility of a child is one of the important issues and the subject of controversy. This has made the examination of the minimum age of criminal responsibility of a child a necessity from the point of view of international documents. Based on this, the aim of this article is to examine the requirements of governments regarding the minimum age of criminal responsibility for children. This is a descriptive analytical article and a library method has been used to investigate the mentioned topic. The findings indicate that over several decades, a series of international law documents have examined the discussion of the minimum age of criminal responsibility and its consequences in regional and international contexts. In documents related binding and consultative texts, legal requirements for the minimum age of criminal responsibility have been emphasized. Minimum age of criminal responsibility The details of the minimum age of criminal responsibility and its implementation clearly stem from the work of the Committee on the Rights of the Child. In fact, the Committee elaborated on the minimum age of criminal responsibility and gained more authority as the body overseeing the most extensive binding legal instrument related to children. As a result, the recommendations of the Committee on the Rights of the Child have been approved to a large extent and over time by other documents and institutions and suggest a general convergence in international standards for determining the minimum age of criminal responsibility in different countries and their implementation.
