رویکرد نظام های حقوقی ایران و انگلستان در قبال بزه دیدگان غیر مستقیم (مقاله علمی وزارت علوم)

چکیده
بزه دیدگان غیرمستقیم از موضوعات مهم در حقوق کیفری ایران است که مهجور مانده است. آسیب های این دسته از بزه دیدگان آثار سوءاجتماعی مهمی به دنبال دارد. ازجمله کشورهای پیشرو در این زمینه، کشور انگلیس است. بر همین اساس بررسی رویکرد نظام های حقوقی ایران و انگلستان در قبال بزه دیدگان غیرمستقیم ضروری است. هدف مقاله حاضر بررسی این سؤال است که رویکرد نظام های حقوقی ایران و انگلستان در قبال بزه دیدگان غیرمستقیم چگونه است؟ مقاله حاضر توصیفی تحلیلی است و با استفاده از روش کتابخانه ای به بررسی سؤال مورد اشاره پرداخته است. یافته ها بر این امر دلالت دارد که نظام حقوقی کشور انگلیس در قیاس با سایر کشورها به خوبی توانسته در قوانین موضوعه خود، بحث حمایت از بزه دیدگان غیرمستقیم را مورد توجه قرار دهد، لیکن ایران، هنوز نتوانسته به رویکرد منسجمی در ارتباط با حمایت از حقوق بزه دیدگان دست یابد. نظام حقوقی ایران، صرفاً در رابطه با بزه دیدگان مستقیم و به صورت پراکنده و در قوانین متعدد، حمایت هایی را در نظر گرفته است، نتیجه این که در ایران دو اشکال اساسی وجود دارد: نخست این که اصلاً توجهی به حقوق بزه دیدگان غیرمستقیم نشده؛ دوم این که حمایت هایی که برای بزه دیدگان مستقیم نیز در نظر گرفته شده، منسجم نیست، به طوری که با مطالعه قوانین و مقررات داخلی ملاحظه می شود که باوجود این که افراد خانواده به طور غیرمستقیم بزه دیده رفتارهای نابهنجار بزهکار می گردند، حمایتی صورت نگرفته است.The Approach of the Iranian and British Legal System towards Indirect Victims
Indirect victims are one of the important issues in Iran's criminal law that have remained neglected. The injuries of this category of victims have important negative social effects. England is one of the leading countries in this field. Based on this, it is necessary to examine the approach of the legal systems of Iran and England towards indirect victims. The purpose of this article is to examine the question of how the legal systems of Iran and England approach indirect victims. The current article is descriptive and analytical and has investigated the mentioned question by using the library method. The findings indicate that Compared to other countries, the British legal system has been able to pay attention to the protection of indirect victims in its related laws, but Iran has not yet been able to achieve a coherent approach in relation to protecting the rights of the victims. Iran's legal system has considered protections only for direct victims and scatteredly and in numerous laws. There are two basic forms in Iran. Firstly, the rights of the indirect victims have not been paid attention to and secondly, the protection provided for the direct victims is not consistent, as it can be seen by studying the domestic laws and regulations that even though the family members are indirectly direct victims of abnormal behavior become criminals, no support has been provided.
