اعمال قواعد امری در داوری تجاری بین المللی

چکیده
یکی از مسائل مهم و تأثیرگذار در داوری تجاری بین المللی، شناسایی و اعمال قواعد امری است که خواست و اراده دولت ها بدان تعلق گرفته و هرگونه توافق، برخلاف آن باطل و بلااثر است. بر این اساس، با فرارسیدن مرحله شناسایی و اجرای رأی اولین مانعی که خودنمایی می کند، قاعده آمره است. پژوهش حاضر بر اساس روش توصیفی- تحلیلی به دنبال پاسخ به این سؤال است که اجرای قواعد امری در داوری تجاری بین المللی چه زمانی است؟ و تأثیر عدم اعمال قواعد امری در داوری تجاری بین المللی چیست؟ فرضیه و یافته ها مؤید این است که محاکم در زمان اجرای رأی ملزم به رعایت قوانین امری هستند و داوران باید در زمان رسیدگی، قواعد آمره کلیه کشورهای درگیر در داوری را مدنظر قرار داده و نسبت به رعایت و اعمال آن ها مبادرت ورزند، در غیر اینصورت عدم اعمال قواعد آمره و نقض آن ها در رسیدگی داوری می تواند منجر به بطلان یا عدم اجرای رأی داوری گردد.Application of Mandatory Rules in International Commercial Arbitration
One of the important and influential issues in international commercial arbitration is the identification and application of mandatory rules, which are subject to the will of the states and any agreement contrary to it is null and void. Accordingly, when the stage of identification and enforcement of the award arrives, the first obstacle that emerges is the mandatory rule. Based on the descriptive-analytical method, the present study seeks to answer the question: When is mandatory rules enforced in international commercial arbitration? And what is the effect of not applying mandatory rules in international commercial arbitration? The hypothesis and findings confirm that courts are required to comply with mandatory rules when enforcing the award, and arbitrators must consider the mandatory rules of all countries involved in the arbitration during the proceedings and strive to comply with and apply them. Otherwise, failure to apply mandatory rules and their violation in the arbitration proceedings can lead to the invalidity or non-enforcement of the arbitral award.
