چکیده
نکاح به عنوان یکی از ارکان اجتماعی، فقهی و حقوقی شناخته می شود و سعی بر آن است که این رکن ثابت بماند اما برخی امور موجب زایل شدن آن می باشند و تدلیس یکی از این موارد است. اگرچه تدلیس در سایر عقود نیز شناخته شده و موجب اثر می باشد، اما بنا بر اهتمام بر تزلزل ناپذیری نکاح در ثبوت تدلیس در برخی حالات تدلیس، من جمله در زمانی که تدلیس به صورت شرط بنایی باشد و همچنین در برخی مصادیق آن شک وجود دارد. در این نوشتار، تدلیس ماهیت شناسی شده و تدلیس ضمنی و بنایی مورد تاییید واقع شده است.Rereading the nature of the option of cheating in marriage
