نظارت اساسی بر همه پرسی تقنینی در ایران و ایتالیا (مقاله علمی وزارت علوم)

چکیده
یکی از طرق مشارکت مستقیم مردم در تصمیم گیری های عمومی در ایران و ایتالیا همه پرسی تقنینی است. در میان اقسام همه پرسی در ایتالیا، همه پرسی ملغاکننده قوانین مصداق همه پرسی تقنینی و مشابه ترین همه پرسی به همه پرسی موضوع اصل 59 قانون اساسی ایران است. یکی از مهم ترین وجوه تشابه این دو همه پرسی آن است که مورد نظارت اساسی قرار می گیرند. این پژوهش در قالبی توصیفی تحلیلی در پی پاسخ به این سؤال بوده که نظارت اساسی بر همه پرسی تقنینی در ایران و ایتالیا چگونه است؟ با مقایسه نظارت اساسی بر همه پرسی تقنینی در ایران و همه پرسی ملغاکننده در ایتالیا، این نتیجه به دست آمد که از آنجا که نظام حقوقی ایتالیا در زمینه تبیین ضوابط شکلی و محتوایی حاکم بر همه پرسی ملغاکننده شفاف تر و دقیق تر است، نظارت اساسی بر همه پرسی تقنینی در ایتالیا از حیث فرایند اعمال آن و هنجارهای حاکم بر این همه پرسی از شفافیت و دقت بیشتری نسبت به نظام حقوقی ایران برخوردار است. از سوی دیگر، تجربه عملی برگزاری همه پرسی های مختلف ملغاکننده در ایتالیا موجب شده برخی از نواقص و کاستی ها با رویه های عملی دادگاه قانون اساسی ایتالیا رفع شوند و حال آنکه به جهت فقدان سابقه برگزاری همه پرسی تقنینی در ایران اساساً نواقص و کاستی های این حوزه برای شورای نگهبان و سایر مراجع و نهادهای مرتبط مجهول استFundamental Oversight of Legislative Referendums in Iran and Italy
One of the ways for direct public participation in decision-making in Iran and Italy is legislative referendums. Among the types of referendums in Italy, the referendum that repeals laws is a specific example of a legislative referendum and is the most similar to the referendum regarding Article 59 of the Iranian Constitution. One of the most significant similarities between these two referendums is that they are subject to fundamental oversight. This research, presented in a descriptive-analytical format, seeks to answer the question of how fundamental oversight is conducted over legislative referendums in Iran and Italy. By comparing fundamental oversight of legislative referendums in Iran with the repealing referendum in Italy, it was found that, since the Italian legal system is clearer and more precise in defining the formal and substantive rules governing the repealing referendum, the fundamental oversight of legislative referendums in Italy is characterized by greater transparency and accuracy regarding the process of its implementation and the norms governing this referendum compared to the Iranian legal system. On the other hand, the practical experience of holding various repealing referendums in Italy has led to the resolution of some deficiencies and shortcomings through the practices of the Italian Constitutional Court, whereas, due to the lack of precedent for holding legislative referendums in Iran, the deficiencies and shortcomings in this area remain unknown to the Guardian Council and other related authorities and institutions.
