چکیده
اختلاف و نزاع در ماهیت و چیستی دلیلْ اعتبار و جایگاه نتایج و داده های تولیدشده توسط هوش مصنوعی در فرایند داوری را می تواند مورد مناقشه قرار دهد. توسعه روزافزون کاربرد هوش مصنوعی در عرصه های مختلف، از جمله داوری و اهمیت مستند و مستدل بودن آرا، فرضیه امکان سنجی استناد به داده های هوشمند را مورد توجه نگارندگان قرار داده است. نگارش حاضر با رویکرد توصیفی تحلیلی نتیجه گیری می کند که نتایج حاصل از ماشین در موارد خاص می تواند در جایگاه نظریه کارشناسی، شهادت، نظریه مشورتی، اماره قضایی یا قانونی قرار بگیرد. اگرچه امکان استناد به خروجی هوش مصنوعی در قوانین حاضر تصریح نشده، از اهداف کلی قوانین داوری برداشت می شود که ارزیابی آزاد ادله به منظور کشف حقیقت از اهمیت والایی برخوردار است. هوش مصنوعی با قابلیت تفکر محاسباتی، پیروی از منطق ریاضی، و قواعد ازپیش تعیین شده می تواند در کشف حقیقت، که از اهداف غایی قانون گذار است، مؤثر باشد.The Validity of Data Generated by Artificial Intelligence in the Arbitration Process
The differences and disputes regarding the nature and essence of the reasons, validity, and place of the results and data generated by artificial intelligence in the arbitration process can be subject to controversy. The increasing development of the use of artificial intelligence in various fields, including arbitration and the importance of documented and well-reasoned opinions, have drawn the author's attention to the hypothesis of the feasibility of citing intelligent data. The present article, with a descriptive-analytical approach, concludes that the results obtained from machines, in certain cases, can be positioned as expert opinions, testimonies, advisory theories, judicial or legal statistics. Although the possibility of relying on the output of artificial intelligence is not specified in the current laws, it can be inferred from the general objectives of the arbitration laws that the free evaluation of evidence to discover the truth is of great importance. Artificial intelligence, with its computational thinking ability, adherence to mathematical logic, and predefined rules, can be effective in uncovering the truth, which aligns with one of the ultimate objectives of the legislator.
