حقوق کودکان از منظر اسناد مرتبط با حقوق بشردوستانه بین المللی

چکیده
حقوق بشردوستانه در قامت حقوق در جنگ، بخش مهمی از مقررات حقوق بین الملل را به خود اختصاص می دهد. بخشی از این مقررات ناظر بر حقوق کودکان در جنگ هستند. این مجموعه مقررات را می توان حقوق بین الملل بشردوستانه کودکان نامید. حقوق بین الملل بشردوستانه کودکان از موضوعات بسیار مهمی است که مقررات قابل توجهی از حقوق بین الملل را به خود اختصاص داده است. وضعیت خاص کودکان به لحاظ سنی، از یک سوی و موضوع جنگ از سوی دیگر، اهمیت حقوق کودکان را دوچندان می کند. به عبارت دیگر گروهی از غیرنظامیانی که در شرایط خاص جنگی، حمایت ویژه تری را می طلبند. اینکه موضع حقوق بین الملل دراین خصوص چیست، موضوعی مفصل است، اما اجمالاً می توان گفت که معاهدات، عرف، اصول کلی حقوقی و سایر منابع حقوق بین الملل خصوصاً در مورد حقوق کودک در شرایط جنگی که از آن تعبیر به حقوق بشردوستانه کودکان می شود، مقرراتی را تعیین و وضع کرده اند؛ بنابراین حقوق کودکان در شرایط جنگی از ابعاد گوناگون قابل بررسی است. در این مقاله به طور خاص اسناد بین المللی مرتبط اعم از معاهدات، برخی رویه های مکتوب سازمان های بین المللی و... مورد بررسی قرار می گیرد تا روشن شود که چه حقوقی در شرایط جنگی براساس اسناد بین المللی مزبور برای کودکان متصور است.The International Humanitarian Rights of Children in War: A Legal Overview

Among the most vulnerable groups in such conflicts are children, whose special needs and fragile circumstances demand particular attention. International humanitarian rights of children are derived from various treaties, customs, and legal principles, establishing protective measures under war conditions. This article provides a comprehensive overview of the legal position on children's rights in armed conflicts, analysing key international documents such as the Geneva Conventions, the Convention on the Rights of the Child, and protocols from international organizations. The study explores the scope, implementation, and limitations of these protections, addressing the challenges in enforcement and the urgent need to strengthen legal mechanisms to safeguard children's rights during war.
