چکیده
انقلاب چهارم صنعتی و پیشرفت های سریع در فناوری هایی مثل هوش مصنوعی، زندگی ما را به شدت تغییر داده اند. این تغییرات بزرگ، باعث شده اند که قوانین فعلی دیگر جوابگوی نیازهای جدید نباشند و لازم باشد قوانین جدیدی نوشته شوند تا با این تحولات هماهنگ شوند. مثلاً، فناوری هایی مثل هوش مصنوعی، ربات ها و اینترنت اشیا، سؤال های جدیدی به عبارت صحیح تر چالش هایی درباره حریم خصوصی، امنیت اطلاعات، مسئولیت پذیری و حقوق مالکیت فکری و... به وجود آورده اند که باید به آن ها پاسخ داده شود. در اینجا با نگاهی توصیفی و تحلیلی این مقاله به این موضوع می پردازد که چرا باید قوانین جدیدی برای این فناوری ها نوشته شود و چه چالش هایی در این راه وجود دارد. مثلاً، وقتی یک سیستم هوش مصنوعی تصمیم اشتباهی می گیرد، چه کسی باید پاسخگو باشد؟ یا چگونه می توان از اطلاعات شخصی افراد در دنیایی که هر روز داده های بیشتری جمع آوری می شود، محافظت کرد؟ همچنین، این جستار تأکید می کند که برای حل این مشکلات، کشورها باید با هم همکاری کنند، چون خیلی از این مسائل، مثل امنیت سایبری یا مالکیت فکری، فقط در یک کشور اتفاق نمی افتد و نیاز به قوانین جهانی دارد. اولویت های سیاست گذاری حقوقی شامل تدوین قوانین شفاف و انعطاف پذیر، تقویت زیرساخت های حقوقی برای حمایت از حریم خصوصی و امنیت داده ها، و ترویج اخلاق فناوری است. هدف نهایی این است که با ایجاد تعادل بین پیشرفت فناوری و ارزش های انسانی، آینده ای امن، عادلانه و پایدار برای همه جوامع فراهم شود. در اینجا نوعا بر اهمیت همکاری بین دولت ها، بخش خصوصی و نهادهای بین المللی برای دستیابی به این هدف تأکید می نماید.Legal policy requirements on the eve of the dramatic developments of the Fourth Industrial Revolution and artificial intelligence with emphasis on challenges and priorities
The Fourth Industrial Revolution and rapid advances in technologies like AI have drastically changed our lives. These big changes have made the current laws no longer meet new needs, and new laws need to be written to align with these developments. For example, technologies like AI, robots and the Internet of things, new questions, more correctly, challenges about privacy, information security, responsibility and intellectual property rights, and so on... They have to be answered. Here, with a descriptive and analytical look, this article looks at why new laws should be written for these technologies and what challenges are there. For example, when an AI system makes the wrong decision, who should be held accountable? Or how can people's personal information be protected in a world where more data is collected every day? Also, the search emphasizes that countries need to work together to solve these problems, because many of these issues, such as cybersecurity or intellectual property, don't just happen in one country and require global laws. Legal Policy Priorities include developing transparent and flexible legislation, strengthening legal infrastructure to protect data privacy and security, and promoting technology ethics. The ultimate goal is to provide a safe, equitable and sustainable future for all societies by striking a balance between technological progress and human values. Here it emphasizes the importance of cooperation between governments, the private sector and international institutions to achieve this goal.
