چکیده
حقوق بش ر دوستانه یک مس ئله جهانی اس ت و تضمین رعایت آن نیز راهکارهای جهانی می طلبد. یکی از راه های حمایت و تضمین رعایت حقوق بش ر دوس تانه، وجود سازوکارهای اجرایی اس ت. از این رو برای حمایت از حقوق بشر دوس تانه در عرصه بین المللی نیاز به سازوکارهای بین المللی است. از سوی دیگر، آخرین گام در فرایند توس عه رژیم های حقوقی، تعبی ه قواعد کیفری در حمایت از اص ول و قواعد آن نظ ام اس ت. در این میان، دیوان کیفری بین المللی ساختار حقوقی نوینی برای تعقیب مرتکبین جنایات بین المللی و ناقضان حقوق انسانهاست. دیوان مزبور از طریق ایجاد پیوند بین صلح و امنیت بین المللی و عدالت کیفری با مقوله حقوق بشر و حقوق بشردوس تانه ارتباط یافته است که در پرتو اساسنامه اش، می تواند نقش مهمی در پیشبرد سیاست های حقوق بشر دوس تانه داشته باشد. تفسیر قواعد اساسنامه بر اساس حقوق بش ر دوستانه، ماهیت حقوق بشر دوس تانه جنایات بین المللی مشمول صلاحیت دی وان و... همگی دال بر تح ول و تکامل حقوق کیفری بین المللی به س مت حمایت س ازمان یافته از حقوق بشر دوس تانه و برخورد کیفری با نقض های بنیادین حقوق بشر دوس تانه می باشد. اما مس اله اصلی مدنظر نوشتار حاضر این است که نقش دیوان بین المللی کیفری در تحقق اهداف و پیشبرد حقوق بشر و تبیین ابعاد ژئوپلیتیک آن چگونه است؟ با توجه به چنین رویکردی، این پژوهش با روشی توصیفی و تحلیلی و با استفاده از منابع کتابخانه ای و اسنادی در پی پاسخگویی به پرسش مطرح شده فوق است.The role of the International Criminal Court in realizing the goals and promoting human rights and explaining its geopolitical dimensions
Friendly human rights is a global issue and guaranteeing its compliance also requires global solutions. One of the ways to support and guarantee the observance of friendly human rights is the existence of executive mechanisms. Therefore, international mechanisms are needed to protect friendly human rights in the international arena. On the other hand, the last step in the development process of legal regimes is the incorporation of criminal rules in support of the principles and rules of that system. Meanwhile, the International Criminal Court is a new legal structure to prosecute the perpetrators of international crimes and human rights violators. By creating a link between peace and international security and criminal justice, the said court has been connected with the category of human rights and humanitarian rights, which, in the light of its statute, can play an important role in promoting human rights-friendly policies. The interpretation of the rules of the statute based on friendly human rights, the nature of friendly human rights, international crimes subject to the jurisdiction of the court, etc., all indicate the evolution and evolution of international criminal law towards the organized protection of friendly human rights and criminal treatment of violations. The fundamental human rights are friendly. But the main issue considered in this article is what is the role of the International Criminal Court in realizing the goals and promoting human rights and explaining its geopolitical dimensions?
