چکیده
شیخ طوسی یکی از بزرگترین علمای جامع الاطراف شیعی است که بسیاری از علمای تشیع و تسنن در محضر او درس آموخته اند. این پژوهش با بررسی آثار فقهی شیخ به تبیین نقش وی در تاسیس و تدوین نظام حقوقی اسلامی می پردازد، که نظام حقوقی که فقه یکی از پایه های آن است. و از آنجایی که بنیان گذار حوزه نجف شیخ طوسی است و همانگونه که بر همگان آشکار است در میان حوزه های علمیه شیعه، حوزه علمیه نجف اشرف از جایگاه ویژه و والایی برخوردار است، در نتیجه پیش از پرداختن به آثار فقهی شیخ به معرفی این حوزه می پردازیم- حوزه ای که در عرصه های سیاسی و علمی چه در گذشته و چه در دوره معاصر تاثیر گذار بوده است، و بسیاری از دانش آموختگان آن در زنده نگاه داشتن و تعیین حدود نظام حقوق اسلامی به ایفای نقش پرداخته اند. این پژوهش با رویکرد تحلیلی-توصیفی و استفاده از روش کتابخانه ای که تکیه گاه اصلی آن آثار خود شیخ است به این ارزیابی می پردازد.Examining the jurisprudential works of Sheikh Tusi in compiling the Shia legal system
Sheikh Tusi is one of the greatest scholars of all Shia fields, and many Shia and Sunni scholars studied under him. By examining the jurisprudence works of the Sheikh, this research explains his role in the establishment and formulation of the Islamic legal system, which is a legal system of which jurisprudence is one of its foundations. And since the founder of the Najaf seminary is Sheikh Tusi, and as it is obvious to everyone, the Najaf Ashraf seminary has a special and high position among the Shia seminaries, as a result, before dealing with the Sheikh's jurisprudential works, I will introduce this seminary. We discuss - a field that has been influential in the political and scientific fields both in the past and in the contemporary period, and many of its scholars have played a role in keeping alive and defining the boundaries of the Islamic legal system. This research deals with this evaluation with an analytical-descriptive approach and using the library method, the main support of which is the Sheikh's own works.
