چگونگی تحقق اندیشه نظارت فقها بر مصوبات مجلس در قانون اساسی جمهوری اسلامی ایران

چکیده
یکی از مسائل مورد نظر روحانیت پس از پیروزی انقلاب، نظارت بر قانونگذاری بود که در قالب اصول شورای نگهبان در قانون اساسی محقق گردید. اما چگونه اندیشه نظارت فقها بر مصوبات مجلس در قالب اصول شورای نگهبان در قانون اساسی مطرح و به تصویب مجلس خبرگان قانون اساسی رسید؟ مقاله حاضر با بهره گیری از منابع اصلی و پژوهش های انجام شده و با تکیه بر رویکرد توصیفی-تحلیلی به این نتیجه می رسد که گنجاندن اصل نظارت فقها بر مصوبات مجلس در پیش نویس های قانون اساسی، پذیرش اصل نظارت فقها بر قانون گذاری توسط نمایندگان جریان های سیاسی حاضر در مجلس خبرگان، تسلط نمایندگان جریان اسلام فقاهتی در مجلس خبرگان قانون اساسی و هژمونیک شدن گفتمان اسلام فقاهتی بعد از تصویب اصل «ولایت فقیه»، سبب شد جریان اسلام فقاهتی به تدریج اصول مورد نظر خود را در قانون اساسی مصوب مجلس خبرگان قانون اساسی بگنجاند. در نتیجه اصول شورای نگهبان به تصویب نمایندگان رسید.How to realize the idea of jurisprudence on the approvals of the parliament in the constitution of the Islamic Republic of Iran
One of the issues considered by the clergy after the victory of the revolution was the supervision of legislation, which was realized in the form of the principles of the Guardian Council in the constitution. But how did the idea of jurists' supervision of the Parliament's approvals in the form of the principles of the Guardian Council in the Constitution come up and was approved by the Assembly of Constitutional Law Experts? This article, using the main sources and conducted researches and relying on the descriptive-analytical approach, comes to the conclusion that the inclusion of the principle of jurists' supervision over the parliament's approvals in the drafts of the constitution, the acceptance of the principle of jurists' supervision over the law. Passing by the representatives of the political currents present in the Assembly of Experts, the dominance of the representatives of the Faqahati Islam movement in the Constitutional Council of Experts and the hegemonic discourse of Faqahati Islam after the approval of the principle of "Jurisprudence", caused the Faqahati Islam movement to gradually adopt its desired principles. to be included in the Constitution approved by the Assembly of Constitutional Law Experts. As a result, the principles of the Guardian Council were approved by the representatives.
