چکیده
نیروهای امنیتی اسرائیل صبح روز ۷ اکتبر ۲۰۲۳، به منظور پاسخ به حمله حماس(گروه مقاومت اسلامی و جهادی)، حملات هوایی را آغاز کردند و فردای آن روز، اسرائیل به طور رسمی آغاز یک عملیات نظامی بزرگ به نام شمشیرهای آهنین را اعلام کرد. این حملات، به کشته شدن تعداد زیادی از افراد غیرنظامی و بی خانمانی هزاران خانواده منجر شد. ازاین رو، نیروهای مسلح اسرائیل مطابق با قواعد عرفی بین المللی جنگ و نیز قواعد وضعی حقوق بین الملل بشردوستانه لازم است و ما در این نوشتار با استفاده از روش تحلیلی و توصیفی به تحلیل جنایات در غزه پرداختیم و به نتایج ذیل رسیدیم که برخلاف تصور عموم مردم، نیروهای امنیتی اسرائیل در غزه مرتکب جنایات جنگی و جنایت علیه بشریت شده اند و جرائمی که نیروهای مسلح اسرائیل انجام داده اند، شامل نقض مکرر حقوق بشری بین المللی و حقوق کیفری بین المللی، نقض حقوق بشردوستانه، نقض حقوق کودکان، خشونت مبتنی بر جنسیت و خشونت علیه مهاجران است.Legal analysis of the 2023 armed conflict between Israel and Hamas (Islamic and Jihadi resistance group)
Israel officially announced the start of a large military operation called "Iron Swords." These attacks resulted in the deaths of many civilians and the displacement of thousands of families. Therefore, analyzing the behavior of Palestinian militants and Israeli armed forces in accordance with international humanitarian law and customary rules of warfare is necessary. In this article, we employed analytical and descriptive methods to examine the crimes committed in Gaza and reached the following conclusions: contrary to popular belief, on one hand, Israeli security forces in Gaza have committed war crimes and crimes against humanity, with their actions involving violations of international human rights law and international criminal law, breaches of humanitarian law, violations of children's rights, gender-based violence, and violence against migrants.
