چکیده
جرایم محیط زیستی یک نگرانی فزاینده است که باعث آسیب قابل توجهی به محیط زیست می شود. در این راستا اگرچه این جرائم به نوعی بشریت را تهدید می کند اما هنوز نظام حقوق بین الملل کیفری نسبت به آن عکس العمل ویژه ای همچون قراردادن نام آن در لیست جرائم صلاحیت جهانی نشان نداده است. از این رو با وجود محدودیت ها، بی کیفرماندن این جرائم به صلاح جامعه جهانی نیست و از طرفی اصل جلوگیری و پیشگیری درهر دو وجه حقوق کیفری و حقوق محیط زیستی بایستی مد نظر باشد. مبارزه با جرایم محیط زیستی جنبه ای از آن چیزی است که سازمان ملل آن را «حاکمیت قواعد محیط زیستی» می نامد. این وضعیتی را توصیف می کند که در آن قوانین به طور گسترده درک، احترام و اجرا می شوند و مردم و کره زمین از مزایای حفاظت از محیط زیست برخوردار می شوند. در این راستا به نظر می رسد با فراگیری دیپلماسی پیشگیری در پرتو حقوق کیفری محیط زیستی، درک عمیق تری از چالش ها و بهترین ابزار برای مبارزه با جرایم محیط زیستی پدیدار شده است.Prevention Diplomacy in the Light of International Environmental Criminal Law
Environmental crime is a growing concern that causes significant damage to the environment. In this regard, although these crimes threaten humanity in some way, the international criminal law system has not yet shown a special reaction to it, such as including its name in the list of crimes of universal jurisdiction. Therefore, despite the limitations, the impunity of these crimes is not in the interest of the international community, and on the other hand, the principle of prevention should be considered in both aspects of criminal law and environmental law. The fight against environmental crimes is an aspect of what the United Nations calls "environmental rule of law". It describes a situation in which laws are widely understood, respected and enforced, and people and the planet enjoy the benefits of environmental protection. In this regard, it seems that with the understanding of prevention diplomacy in the light of environmental criminal law, a deeper understanding of the challenges and the best tools to fight environmental crimes has emerged.
