واکاوی اهمیت «سوگند» در حیات حقوقی و اجتماعی تمدن عیلام قدیم (2500 ق.م – 650 ق.م)

چکیده
محققان شیوه عملی آیین «سوگند خوردن» را بازتابی از سنت دیرین آزمایش ایزدی می دانند که برای اثبات حقانیت میان طرفین دعوی به کار می رفته است. ای ن آزمون ها در ای ران و جهان باستان با ن ام هایی همچون وَر، ایلونرو، دیویه، اوردالی و جز اینها خوانده ش ده اس ت. در تاریخ عیلام نیز «سوگند» تحت عناوین و شیوه های خاصی رواج داشته است؛ چنان که الواح سنگی تمدن عیلام به مثابه قراردادهای حقوقی آن دوران، این امر را تأیید می کند. لیکن سیر تطور این مفهوم و ارزیابی میزان وفاداری عیلامی ها به سوگندهای خویش و احیاناً تاوان سوگندشکنی نزد ایشان، همچنان در هاله ای از ابهام است. درحالی که با واکاوی سوگندهای این دوران، می توان به نمادها، باورها و ارزش های فرهنگی، سیاسی و اجتماعی جامعه عیلامی پی برد و علل تحکیم و یا افول سوگند و پیمان ها را درک کرد. بنابراین، مقاله حاضر به دنبال پاسخ به این پرسش بنیادین بوده است که پیشینه فرهنگی انواع سوگند و نقش آن در ابعاد مختلف حقوقی و اجتماعی تمدن عیلام چیست؟ از نتایج تحقیق برمی آید که سوگندهای شفاهی و عملی در این دوران ابتدا مبنایی مذهبی و حقوقی داشته و به تدریج کارکردهای وسیع تری جسته و به حوزه های فرهنگی، اجتماعی و سیاسی تسری یافته اند.متن
The Role and Status of Oath in the Social History of Antique Elam Civilization
Scholars believe that the practical method of swearing is the reflection of ancient custom of ordalie which it has been used to proving the right between claimant and defendant. This kind of exams in Iran and the ancient world are named: var; ilunaru; diviya; ordalie and etc. oath was named in several titles and methods in Elam, as well. it can be seen in Elamite tablets as legal treaties. But the evolution process of this subject and the assessment of the Elamites loyalty to their swearing or the punishment of abjuration for them are still hidden. While according to the oaths of this era, can be found symbols, beliefs and moral, religious, political and social values of elamite society and the causes of Strength and weaknesses of oaths and treaties can be realized. Therefore, concerning the thoughts and beliefs of the contemporary people of the Elamite civilization in the ancient Near East, the present study describes the origins, principales and dominance of the Elamite civilization firstly. Then will be answered to the what are the kinds and role of oath in different social dimensions of the ancient Elam.it seems that oral and practical oaths in this eara were religious and legal at the beginning and gradually expanded into social, cultural and political domains.
