چکیده
حق بر جبران خسارت در عصر امروز یکی از اصول کلی حقوق به شمار می رود که به مقتضای آن هر شخصی که متحمل خسارت شود، حق بر جبران خسارت وارده به او از بدیهیات حقوقی است و شخصی هم که ورود خسارت به دیگری منتسب به او باشد، تکلیف قانونی و اجتماعی به جبران خسارت وارده را دارد. بی تردید در جبران خسارات از دیدگاه اقتصادی باید به آسان ترین شیوه ممکن با بالاترین کارایی اجتماعی و اقتصادی عمل کرد. رویکرد ایفای نقش فاعل زیان در جبران خسارت با رضایت زیان دیده بر مبنای حسن نیت در جبران عینی در خساراتی که جبران عینی امکان پذیر باشد، بعد از صدور حکم و در جریان رسیدگی و یا حتی بدون اقامه دعوا، روش با کیفیت مطلوبی از جبران خسارت است که در این پژوهش مبانی اقتصادی آن با روش تحلیلی توصیفی با تحقق جبران کامل خسارت و تحقق هدف پیشگیری و کاهش هزینه (با افزایش فایده) نویدبخش کارایی اقتصادی این رویکرد در نظام جبران خسارت خواهد شد.Economic Principles of the Approach of Playing the Role of the Cause of Loss in Compensation
