چکیده
فناوری های دارای هوش مصنوعی خودمختار در برخورد با حقوق اسلامی از یکسو اثرگذار و از جنبه ای دیگر اثرپذیر هستند. اثرگذاری هوش مصنوعی بر جنبه های مختلف حقوق اسلامی به ایجاد چالش های متعدد است و در مقابل اثرپذیری از حقوق اسلامی نیز به معنای قانونمندی و راهبری هوش مصنوعی با الزامات حقوق اسلامی است. پژوهش حاضر در گام نخست با تمسک به رویکرد توصیفی – تحلیلی و استفاده از روش تطبیقی به تبیین چالش های حقوق اسلامی در برخورد با هوش مصنوعی خودمختار خصوصاً امکان اعطای شخصیت به هوش مصنوعی پرداخته است. سپس با توجه به ضرورت اثرگذاری حقوق اسلامی، روش هایی از قبیل تعریف اخلاق اسلامی برای هوش مصنوعی و بهره مندی مناسب از بسترهای حقوقی و قانونی مرتبط در سایر نظام های حقوقی را پیشنهاد نموده است؛ به طوری که استانداردسازی مناسب این فناوری یکی از بسترهای تمدن سازی نوین اسلامی باشد.Examining The Mutual Impact Of Autonomous Artificial Intelligence And Islamic Law
Autonomous Artificial Intelligence is both effective and ineffective when interacting with islamic law. The influence of artificial intelligence on various aspects of islamic law causes many challenges, on the other hand, influence by Islamic law also means to legislate and guide artificial intelligence with the requirements of islamic law. First of all, this research explaines the challenges of Islamic law, especially the possibility of granting legal personality to artificial intelligence, by resorting to the descriptive-analytical approach and using the comparative method. Considering the necessity of effecting Islamic law, this research has proposed methods such as defining islamic ethics for artificial intelligence and the appropriate usage of related legal platforms in other legal systems, aiming at the the proper standardization of artificial intelligence is one of the foundations of modern Islamic civilization.
