ممنوعیت حکم به خرید مال به عنوان مجازات جایگزین حبس در نظام کیفری ایران

چکیده
قانون گذار در قانون مجازات اسلامی مصوب 1392 جهت تعدیل نظام حقوقی کیفری کشور، اقدام به تقنین نهادهای نوین کیفری، جهت اصلاح مجرمین و کاهش جمعیت کیفری زندان ها نمود؛ در این راستا یکی از این نهادها، مجازات جایگزین حبس می باشد که این مجازات نیز شقوق متعدد داشته و در مقاله پیش رو موضوع «خدمات عمومی رایگان»، مورد بحث و بررسی قرار می گیرد؛ آنچه از این بررسی حاصل می گردد؛ این است که صدور حکم به مجازات جایگزین حبس تحت عنوان «خرید مال»، جهت نهاد یا سازمان خاص یا اشخاص حقیقی یا حقوقی با توجه به اینکه در قانون مجازات، چنین عنوانی پیش بینی نشده است، دارای ایراد و اشکال حقوقی و قانونی است و در نظام کیفری تقنینی حال حاضر کشور با توجه به قوانین و دستورالعمل های مرتبط، امکان پذیر نمی باشد؛ از آنجاکه بررسی این بیع الزامی، تلاقی حقوق کیفری و حقوق خصوصی است، واجد اهمیت وافری می باشد؛ این مقاله سعی دارد به این موضوع، به صورت تخصصی پرداخته و اشکالات و ایرادات آن را مطمح نظر قرار دهد.Prohibition of order to purchase property as an alternative punishment to imprisonment in Iran's criminal system«

In this regard, one of these institutions is the alternative punishment of imprisonment, which itself has different divisions and will be discussed and analyzed in the upcoming article "Free public services". And it is clear that the issuance of a sentence of punishment instead of imprisonment under the title of "property purchase" for a specific institution or organization or natural or legal persons, considering that it is not provided for in the law, has legal and legal problems. And it is not possible in the current legal criminal system of the country according to the related laws and guidelines ; Since the examination of this mandatory sale is the intersection of criminal law and private law, it is of particular importance. This article tries to deal with this issue in a specialized way and to point out its problems and defects.
