ریشه های حقوق عمومی در آرای فلسفی توماس هابز

چکیده
در موضوع ریشه های حقوق عمومی، علاوه بر هابز، سایر اندیشمندان از جمله جان لاک با نظریه قرارداد اجتماعی نیز نظریات زیادی را مطرح کرده اند. در نظریات اندیشمندان حوزه سیاست، درگذر تاریخ از حقوق عمومی به عنوان حقوق سیاسی یادشده است. لذا حقوق عمومی رشته ای از حقوق است که به بررسی پدیده های سیاسی می پردازد که شامل نهادها و مسائل سیاسی در یک جامعه است. به نظر می رسد توماس هابز با معرفی قرارداد اجتماعی ازجمله اندیشمندان حقوق سیاسی یا همان حقوق عمومی است که بیشترین تأثیر را در حوزه سیاسی و حکمرانی داشته است. هابز با بیان وضع طبیعی به رابطه حقوقی بین اتباع و حاکم پرداخته است. هابز تلاش کرد تا فلسفه سیاسی خود را از متافیزیک به اصول و قوانین فیزیک تقلیل دهد. بدین معنی که در فلسفه سیاسی هابز سعی شده است تا به عناصری پرداخته شود که قابل اثبات باشد. لذا در بحث دولت، انسان را که قابل شناخت است به بررسی گرفته و سعی کرده است تا دولت را موجودی انسان وار دارای حرکت معرفی کند. با توجه به وضع طبیعی و جنگ همه علیه همه، انسان مجبور می شود حقوق خود را به دیگری برای دست یابی به هدف کلانتر که همان امنیت و رفاه است واگذار کند. درواقع هابز با تفکیک انواع دولت به نوعی خود را طرف دار حکومت شاهی و بهترین نوع آن می داند. این مقاله با روش توصیفی-تحلیلی بر آن است تا تأثیر آراء هابز بر حقوق عمومی را مورد بررسی قرار داده است.The origins of public law in the philosophical opinions of Thomas Hobbes
On the basic theme of the origins of general rights, in spite of Hobbes, other theorizers have proposed many theories as well; including John Locke with the theory of social contract. In the opinions of political theorizers, throughout the history, general rights have been referred to a political right. Therefore, general right is a field of rights that examines political phenomena that include institutions and political issues in a society. So, it seems that one of the theorizers of political rights or general rights who had the greatest influence in the field of politics and governance was Thomas Hobbes with the introduction of the social contract.Hobbes has discussed the natural state and the legal relationship between nationals and the rulers, Hobbes tried to reduce his political philosophic thoughts from metaphysics to the principles and statues of physics. This means that Hobbes's political philosophy has tried to address elements that can be proven. Therefore, in the discussion of the state, he examined the human being who can be known and tried to introduce the state as a human-like being and considers this being as a state of motivation. Then due to the natural situation and the war of all against all, mankind is forced to surrender his rights to another to achieve the colossal goals, which is security and prosperity. In fact, Hobbes, by distinguishing the types of government, he was adherent of royal government and considers it the best type. This article, with a descriptive-analytical method, aims to examine the impact of Hobbes' opinions on general rights.
