چکیده
مشهور فقیهان عقیده دارد: «اگر مدت در نکاح منقطع ذکر نشود، به دائم تبدیل می شود». این نظر موجب تخطی تأثیر متقابل بین قصد و مدت نکاح تلقی می شود. تخطی مزبور باعث طرح قول فقیهان غیرمشهور بر بطلان چنین عقدی شده است. هرچند مقاله ای در پیشینه تحقیق وجود دارد اما به نزاع در مسئله با ارایه یک راه حل مقبول طرفین پایان نداده است. این وضعیت سبب سؤال تحقیق حاضر شده است که: «تبدیل نکاح منقطع به دائم در صورت ترک مدت با کدام راه حل فقهی حقوقی قابل تصحیح است، به طوری که منجر به تخطی از قاعده قصد نگردد یا تخطی را با اصول و قواعد حقوقی و فتوای مشهور موردنظر اصل 167 قانون اساسی و ماده سوم قانون آئین دادرسی مدنی توجیه نماید؟». روش تحقیق در یافتن پاسخ این سؤال، تحلیلی و بهره گیری از ابزار کتابخانه است و به این نتیجه رسیده است که: چندین راه حل مورد غلفت مقاله مزبور در تصحیح مسئله تحقیق قابل ارایه است.Rereading the Mutual Effect of Intention and Duration of Marriage and Its Correction Solutions

The aim of the present study is to find a solution to this fundamental research question and This opinion violates the mutual influence between intention and duration of marriage. The mentioned violation has caused another opinion of the jurists on the nullity of such a contract. Although there is a research paper in the background of the research, it has not ended the dispute by providing a solution acceptable to the parties. This situation has caused the present research question that: "The Conversion of a broken marriage to a permanent one in case of leaving the period can be corrected with which jurisprudential solution, so that it does not lead to a violation of the rule of intention or a violation of the legal principles and rules and the famous fatwa referred to in Article 167 of the Law Basic and Article 3 of the Civil Procedure Law justify it?" The research method in finding the answer to this question is analytical and using library tools, and it has come to the conclusion that: In the mentioned article, several solutions have been presented to correct the research problem.
