موضوع شناسی فرقه های انحرافی و کاربست آن در «ماده 500» مکرر قانون مجازات اسلامی

چکیده
قوانین ناظر به مواجهه با فرقه های انحرافی، باید از جامعیت و مانعیّت لازم برخوردار باشد تا راه را در برابر تأسیس و ترویج آنان ببندد. ماده 500 مکرر قانون مجازات اسلامی (مصوب 24/10/1399)، در پی جبران خلأ های قانونی در این باره بوده و توانسته است تا مقدار قابل قبولی به این موضوع بپردازد. ازآنجاکه شناخت دقیق مجریان و نهادهای مربوطه، از فرقه های انحرافی به عنوان پیش نیاز فهم و دریافت درست این ماده و مواد مرتبط با آن تلقی می شود، این نوشته با عرضه تحلیل شناختی از فرقه های انحرافی، بن مایه های لازم را برای تفسیر این ماده فراهم ساخته و تلاش کرده است تا به چیستی فرقه ها و چگونگی عملکرد آنان در جامعه، به عنوان پرسش این پژوهش نگریسته و کاربست آن در ماده مذکور را بررسی کند. در این راستا، مؤلفه هایی همچون: تعاریف دقیق اصطلاحات، معرفی فرقه های فعال در ایران، آسیب شناسی و معرفی روش های کنترل ذهن در فرقه ها را مورد مطالعه قرار داده است. روش پژوهش، توصیفی- تحلیلی است و افزون بر معرفی ابعاد فرقه، به تحلیل اندیشه های آنان اقدام کرده استSubject Analysis of Deviant Sects and Its Application in the Recurrent Article 500 of the Islamic Penal Code
The laws governing the confrontation with deviant sects must have the necessary comprehensiveness and deterrent power to close the path for the establishment and promotion of such sects. The Recurrent Article 500 of the Islamic Penal Code (approved on January 13، 2021) aims to fill the legal gaps in this regard and has been able to address this issue to a significant extent. Since a precise understanding by the relevant authorities and institutions of the deviant sects is considered a prerequisite for the proper understanding and interpretation of this article and its related provisions، this paper provides a cognitive analysis of deviant sects، offering the necessary foundation for interpreting this article. It examines the nature of sects and their operations in society as the main question of the study، analyzing its application within the context of the mentioned article. In this context، elements such as precise definitions of terms، an introduction to active sects in Iran، harm analysis، and the introduction of mind control methods within sects have been studied. The research method is descriptive-analytical، and in addition to introducing the dimensions of sects، it also analyzes their ideologies
