تحلیل مبانی جرم انگاری تقلب در تهیه آثار علمی؛ با تا کید بر حق بنیادین اشتغال و توسعه مرزهای دانش

چکیده
قانون پیشگیری و مقابله با تقلب در تهیه آثار علمی با هدف سالم سازی فضای علمی پژوهشی کشور در سال 1396 به تصویب رسید. صرف نظر از ایرادهای وارده بر قانون ازجمله تمرکز بیشتر بر معلول (نه عامل جرم)، پرسش های دیگری نیز در خصوص مبانی جرم انگاری آن مطرح است و اینکه آیا در تدوین آن به مبانی و اصول جرم انگاری توجه شده است یا خیر؟ در واقع این پرسش مطرح است که رفتار تهیه کنندگان آثار علمی که با رضایت و گرفتن حق الزحمه، حاصل اندیشه خود را به دیگران ارائه می کنند با کدام یک از مبانی جرم انگاری همخوانی دارد؟ اگر مهم ترین مبنای جرم انگاری را اصل صدمه بدانیم، آیا این رفتار به چه منافع اساسی و حیاتی لطمه وارد می کند؟ افزون بر این رابطه جرم انگاری این رفتار با اصل بنیادین حق اشتغال و توسعه مرزهای دانش چگونه است؟ فرضیه مقاله آن است که گرچه تا حدودی می توان مبنای صدمه به فضای علمی پژوهشی را در جرم انگاری این قانون ملاحظه کرد ولی در مورد حق بنیادین اشتغال برای فارغ التحصیلان بیکار که بعضاً به تهیه آثار علمی برای دیگران مبادرت می کنند و نیز حق جامعه بر توسعه مرزهای دانش نمی توان دفاع قابل قبولی داشت.Analysis of the Principles of Criminalization of Fraud in the Preparation of Scientific Works; with Emphasis on the Fundamental Right to Employment and the Development of Knowledge Frontiers
The Law on Prevention and Combating Fraud in the Preparation of Scientific Works with the aim of creating a hall for the research space of the country was approved in 2017. Apart from the objections to this law, such as its focus on the disabled rather than the perpetrator, there are other questions about this law, such as whether the principles of criminality have been taken into account in the drafting of this law or not. In fact, the behavior of the producers of scientific works who present their ideas to others with their consent for the applicants and by receiving a fee, is consistent with which of the principles of criminalization? If we consider the most important basis of criminalization as the principle of harm, what are the basic and vital benefits of this behavior? In addition, what is the criminalization of this behavior with the fundamental principle of the right to employment? This article seeks to answer these questions.
