چکیده
ساختار بیت کوین به عنوان اولین رمزارز بر سه پایه رمزنگاری، عدم تمرکز و برگشت ناپذیری تراکنش ها استوار شده است. عدم تمرکز در رمزارزها به ایجاد دفاتر کل توزیع شده منتهی می شود و رمزنگاری و برگشت ناپذیری نیز هریک به گونه ای به ارتقای امنیت رمزارزها می انجامند. مشروعیت استفاده از بیت کوین و دیگر رمزارزها، در گرو مشروع بودن قوانین حاکم بر دفتر کل رمزارز مزبور و دوری از خطوط قرمزی مانند قمار می باشد که محور این تحقیق را به خود اختصاص داده است. در قیود و شروط تحقق قمار دیدگاه های گوناگونی در میان فقها وجود دارد. این اختلافات و گوناگونی اندیشه ها، به شکل گیری استنباطات مختلفی در مورد قمار انجامیده است که ممکن است در صدق عنوان قمار بر بیت کوین مؤثر باشد. تحقیق کنونی با روش توصیفی تحلیلی و با تأکید بر آرای امام خمینی به تبیین مفهوم قمار در دفتر کل بیت کوین به عنوان قدیمی ترین و مهم ترین رمزارز پرداخته و ضمن تشریح مفاهیم بنیادی بیت کوین و قوانین حاکم بر آن، به این نتیجه دست یافت که دفتر کل توزیع شده بیت کوین آلوده به قمار نیست؛ هرچند بررسی قمارگونه بودن معاملات ثانویه آن نیازمند تحقیقات مستقلی می باشد.Evaluating the Gambling-likeness of Bitcoin's Distributed Ledger with Emphasis on Imam Khomeini's Jurisprudence thought
The structure of Bitcoin as the first cryptocurrency is based on the three foundations of cryptography, decentralization and irreversibility of transactions. The lack of concentration in cryptocurrencies leads to the creation of distributed ledgers, and encryption and irreversibility each lead to the improvement of the security of cryptocurrencies. The legitimacy of using Bitcoin and other cryptocurrencies depends on the legitimacy of the laws governing the cryptocurrency ledger and avoiding red lines such as gambling, which is the focus of this research. There are different views among the jurists regarding the restrictions and conditions of gambling. These differences and diversity of thoughts have led to the formation of various conclusions about gambling, which may be effective in the case of the title of gambling on Bitcoin. The current research, with a descriptive and analytical method and with an emphasis on Imam Khomeini's (RA) opinions, explained the concept of gambling in the ledger of Bitcoin as the oldest and most important cryptocurrency, and while explaining the fundamental concepts of Bitcoin and the laws governing it, reached this conclusion. It was found that the distributed ledger of Bitcoin is not contaminated with gambling, although the investigation of the gambling nature of its secondary transactions requires independent research.
