چکیده
قراردادهای حرفه ای در ورزش از جمله قراردادهای خدماتی می باشند. بر مبنای این قراردادها شخص حرفه ای در چارچوب شروط قراردادی متعهد به تعهدات حرفه ای برای باشگاه خاصی میشود. این قراردادها از آنجایی که ارتباط مستقیمی در نظام اقتصادی دارند دارای اهمیت بسیاری می باشند، به طوری که بسیاری از چالش های مهم در این رابطه در حمایت قانونی قرار گرفته است. از جمله مهمترین چالش های مربوط به قراردادهای حرفه ای در حوزه ورزش را می توان به عدم اهلیت قانونی برخی ورزشکاران در انعقاد قرارداد عنوان کرد زیرا این افراد به فراخور صغر سنی که دارند هرچند در فعالیت خاصی حرفه ای می باشند ولی از نظر سنی اهلیت لازم را برای انعقاد قرارداد ندارند. دومین چالش قراردادهای حرفه ای در ورزش را می توان «شرط عدم رقابت» دانست که در برخی از قراردادها نسبت به شخص حرفه ای این شرط گنجانده می شود و بر اساس آن ورزشکار نمی تواند تا مدت معینی برای تیم های رقیب فعالیت کرده و این عدم فعالیت شامل دوران پس از اتمام قرارداد نیز می شود. در این مقاله سعی شده است قراردادهای حرفه ای در ورزش مورد تشریح قرار گرفته و همچنین برخی چالش های حقوقی در این رابطه مورد ارزیابی و تحلیل قرار گیرد.Examining the challenges of professional contracts in sports with a look at the laws of the Islamic Republic of Iran
Professional contracts in sports are service contracts. Based on these contracts, a professional person is committed to professional obligations for a specific club within the framework of the contractual terms. Since these contracts are directly related to the economic system, they are of great importance, so that many important challenges in this regard have been legally supported. Among the most important challenges related to professional contracts in the field of sports can be considered the legal incapacity of some athletes to conclude contracts because these people, despite their young age, although they are professionals in a particular activity, do not have the necessary age to conclude contracts. The second challenge of professional contracts in sports can be considered the "non-compete clause" which is included in some contracts for professional persons, and based on which the athlete cannot work for competing teams for a certain period of time, and this non-activity also includes the period after the contract ends. In this article, an attempt has been made to describe professional contracts in sports and also to evaluate and analyze some legal challenges in this regard.
