چکیده
زمینه و هدف: دولت های مدرن همواره خود را عامل اراده عمومی و حافظ منافع و اهداف عمومی می دانند. افکار عمومی نیز دولت ها را بر اساس توجه آن ها به اهداف عمومی مورد سنجش قرار می دهند. یکی از اهداف عمومی دولت ها در زمینه تحقق حکمرانی مطلوب، توسعه زیرساخت ها و افزایش رفاه عمومی است که در این زمینه اغلب دولت ها تلاش دارند تا با جذب سرمایه گذاری خارجی، در این زمینه به موفقیت های بیشتری برسند. مواد و روش ها: این تحقیق از نوع نظری بوده روش تحقیق به صورت توصیفی تحلیلی می باشد و روش جمع آوری اطلاعات به صورت کتابخانه ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. یافته ها: با توجه به بلندمدت بودن دوره قراردادهای سرمایه گذاری و دوران بهره برداری از آن، ممکن است تغییر افکار عمومی، تغییرات بنیادی در ساختار دولت ها، انقلاب ها ممکن است موجب تغییر نگرش به اهداف عمومی و سلب مالکیت، مصادره و ملی سازی اموال سرمایه گذار گردد. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت داری رعایت شده است. نتیجه گیری: در این خصوص مسائل متعددی مطرح است که یکی از مهم ترین آن ها، نقش حکمرانی خوب در تعیین مشروع بودن یا نبودن سلب مالکیت در راستای اهداف عمومی است. در نتیجه بررسی صورت گرفته مشخص خواهد شد که امروزه اصول حکمرانی مطلوب به عنوان یکی از مشوق های تأثیرگذار بر تداوم سرمایه گذاری خارجی شده است.expropriation of foreign investmentin the framework of Good governance
Background and Aim : Modern governments always consider themselves agents of public will and protectors of public interests and goals. Public opinion also measures governments based on their attention to public goals. One of the general goals of governments in the field of achieving good governance is to develop infrastructure and increase public welfare, and in this field, most governments try to achieve more success in this field by attracting foreign investment. Materials and Methods : This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Findings : Due to the long-term nature of the investment contracts and the period of its exploitation, there may be changes in public opinion, fundamental changes in the structure of governments, revolutions may cause a change in attitude towards public goals and expropriation, confiscation and nationalization of the investor's property. Ethical Considerations : In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Conclusion : In this regard, there are many issues, one of the most important of which is the role of good governance in determining the legitimacy or not of expropriation in line with public goals. As a result of the investigation, it will be clear that today the principles of good governance have become one of the incentives influencing the continuation of foreign investment.
