تکالیف بیماران روانی ازدیدگاه فقه فریقین و عرفان اسلامی (مقاله علمی وزارت علوم)

چکیده
امروزه وجود بیماران روانی و افزایش روز افزون آن بخصوص در شهرهای بزرگ یکی از معضلات جدی جامعه جهانی به حساب می آید که مورد توجه روان شناسان و جامعه شناسان قرارگرفته است. اگرچه در فقه امامیه، عامه و نیز حقوق موضوعه ایران از بخش از جامعه به عنوان محجورین یاد شده و حقوق و تکالیف آنان بطور کامل بیان شده است اما وضع بیماران روانی که معمولا چنین طیف از جامعه در شرایط غیرطبیعی به سر می برند و با مشکلات گوناگون دست و پنجه نرم می کنند، از لحاظ حقوقی مبهم است و هیچ حکم فقهی و قانونی در این زمینه وجود ندارد. و اما در حوزه معارف اسلام با توجه به ملاک های اخلاقی- عرفانی و دغدغه حرمت انسانی که در اسلام وجود دارد، به حقوق بیماران روانی وکسانی که دچار نقایص روحی هستند، بذل عنایت گردیده است. برخی از این بیماران دارای ناهنجاری های شدیدی روانی هستند به گونه ای که مانند دیگر افراد جامعه قادر به زندگی عادی نبوده وبا پدیده های پیرامون خود واکنش غیر عادی نشان می دهند واز این رو ممکن است خود و اطرافیان خود را مورد تهدید قرار دهند و بر هر انسان متعهد به با ور های اخلاقی و انسانی لازم است تا با توجه به وضعیت روحی وشأنیت اینگونه افراد رفتار کنند. پژوهش حاضر سعی کرده است تعریف روشنی از بیماران روانی ارائه دهد و نیز به برخی آن ها از لحاظ میزان تشخیص ودرک که دارند اشاره کند در این نوشتار نیز ضرورت محجوریت آنان با استناد به دلایل فقهی و حقوقی مورد کنکاش قرار گرفته و به میزان محجوریت آنان اشاره شده است.Obligations of Insane Patients from Standpoint of Farighain Jurisprudence and Islamic Mysticism
Today the existing insane patients and their increase in megacities is a serious problem for the world community, that is considered by psychologists and sociologists. Although in Imamate jurisprudence the public and the relevant laws in Iran a portion of the society are referred to as incapacitated person and their obligations and rights are fully explained, the status of insane patients who are living in an unnatural situation struggling with different problems is legally unknown and there is no jurisprudent or legal judgement to that. However, in the Islamic jurisdiction, due to the ethical mystical criteria and the concern over dignity of human being, the rights of insane patients and those with mental disorder are taken into account . Some patients are seriously having mental disorders so that just like other people of society are not able to have a normal life and react to the surrounding phenomena abnormally. Thus, it is likely that they could threaten themselves or the people around them. Therefore, it is the task of any committed person toward ethical and humane beliefs to behave them according to their mental status and their dignity .
The present paper endeavors to make a transparent definition of insane patients and point out to a few of them in terms of their level of cognition and recognition. In addition, this paper seeks to examine the necessity of their incapacitation with reference to jurisprudent and legal evidences and their level of incapacitation .
