چکیده
زمینه و هدف: هدف از پژوهش حاضر تحلیل منفعت عمومی در رویه قضایی دیوان عدالت اداری با قاعده تسلیط با تأکید بر اقدام شهرداری ها است. مواد و روش ها : این تحقیق از نوع نظری است روش تحقیق به صورت توصیفی-تحلیلی و روش گرد آوری اطلاعات به صورت کتاب خانه ای است که با مراجعه به اسناد، کتاب ها و مقاله ها انجام شده است. یافته ها : موضوع مالکیت یکی از مهم ترین مباحث فقهی و حقوقی است و جایگاه منفعت عمومی با مفاهیمی نظیر خدمت عمومی، رفاه عمومی و آسایش عمومی از موضوعات بسیار مهم مطرح در رابطه با حفظ حقوق عامه است. اما قانون گذار گاهی برای حفظ مصالح عمومی، حق مالکیت افراد را محدود یا سلب کرده است. ملاحظات اخلاقی : در همه مراحل تدوین پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت داری رعایت شده است. نتیجه گیری : دیوان عدالت اداری مهم ترین ارگان تضمین کننده سلامت اداری در حوزه حقوق اداری ایران؛ دارای نقش به سزایی است. یکی از منابع مهم در این زمینه رویه های متخذه در هیئت عمومی این نهاد دادرسی است که موجب ایجاد عدالت در روابط مردم با دولت است و منشأ اتخاذ تصمیمات مناسب در مؤسسات عمومی دولتی و یا عمومی غیر دولتی نیز می شود.Analysis of public interest in the judicial procedure of the Court of Administrative Justice with the rule of subordination, emphasizing the action of municipalities
Background and Aim: The purpose of the current research is to analyze the public interest in the judicial procedure of the Administrative Court of Justice with the rule of appeasement, emphasizing the action of municipalities. Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Findings: The issue of ownership is one of the most important jurisprudential and legal issues, and the position of public interest with concepts such as public service, public welfare, and public comfort is one of the most important issues raised in relation to the preservation of public rights. But the legislator has sometimes limited or denied the property rights of individuals to protect public interests. Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Conclusion: the Court of Administrative Justice is the most important organ that guarantees administrative health in the field of administrative law in Iran; It has a significant role; Especially, one of the important sources in this field is the procedures taken in the general body of this judicial institution, which creates justice in the relations between the people and the government, and is the source of making appropriate decisions in public governmental or non-governmental public institutions.
