چکیده
موسیقی به عنوان یکی از هنرهای هفتگانه، در تمام جوامع از گذشته و حال وجود داشته و به عنوان یکی از ویژگی های مهم و قابل توجه فرهنگ جهانی در نظر گرفته می شود. احساسات و ایده هایی که موسیقی بیان می کند، موقعیت هایی که در آن موسیقی پخش می شود و به آن گوش داده می شود و نگرش نسبت به نوازندگان موسیقی و آهنگسازان به شدت تحت تاثیر عوامل اجتماعی، اقتصادی، آب و هوا، دسترسی به فناوری و مسائل دینی قرار دارد. هنرمندان در طول زمان به این نتیجه رسیده اند اجرای برخی حقوق مربوط به آثارشان به تنهایی دشوار و در بسیاری موارد غیرممکن است و بهتر است نهادی جهت پیگیری و مدیریت حقوق آنها باشد تا بتوانند با فراغ بال بیشتری به آفرینش و خلق آثار جدید بی اندیشند؛ لذا در هر کشوری طبق شرایط و موقعیت خود و گاهی با استفاده از تجربیات سایر کشورها انواع سازمان های مدیریت جمعی حق مولف و حقوق مرتبط را تشکیل داده اند. ایجاد نظام مدیریت جمعی حق مولف در ایران می تواند موجب ارتقای سطح حمایت از حق مؤلف و حقوق مرتبط و حرفه ای شدن تجارت در این زمینه ها گردد و بدین وسیله موقعیت صاحبان حقوق همچون آهنگسازان، خوانندگان، نویسندگان و هنرمندان را بهبود بخشد به گونه ای که به بهترین شکل از منافع تجاری اثر خود برخوردار شوند و از طرف دیگر منجر به رشد صنایع فرهنگی و هنری درکشور می شود و نیاز جامعه و مصرف کنندگان را به شکل بهتری تامین می کند.A comparative study of collective management of copyright in musical works

Artists have come to the conclusion over time that the implementation of some rights related to their works alone is difficult and in many cases impossible, and it is better to have an institution to pursue and manage their rights so that they can create new works with more leeway. Think; Therefore, in each country, according to their conditions and sometimes using the experiences of other countries, various types of collective management organizations have formed copyright and related rights. Establishing a collective copyright management system in Iran can raise the level of copyright and related rights protection and professionalize the business in these areas, thereby improving the position of copyright holders such as composers, singers, writers and artists. The species that best enjoy the commercial benefits of their work and on the other hand leads to the growth of cultural and artistic industries in the country and better meets the needs of society and consumers.
