چکیده
در رویکرد حق محور به تأمین اجتماعی، افراد مقیم یک کشور فارغ از تعلق به سرزمین یا قلمرو جغرافیایی خاص و نیز عضویت در نظام سیاسی دولت- کشور، صرفاً به این دلیل که انسان هستند مشمول حمایت های تأمین اجتماعی از قبیل مستمری های بازنشستگی، ازکارافتادگی، فوت، بیمه درمان و ....قرار می گیرند. لذا اتباع بیگانه نیز مستقلاً و بدون نیاز به داشتن تابعیت کشوری که در آن سکونت و یا اقامت دارند از این حق برخوردارند و نظام های حقوقی داخلی می بایست در راستای تعهدات بین المللی و حقوق بشری خود بر موانعی که در برابر بهره مندی کامل اتباع بیگانه از حق تأمین اجتماعی وجود دارد، فایق آیند. روند تضمین حق تأمین اجتماعی اتباع بیگانه و حمایت از این حق درکشورهای مختلف با سرعت متفاوتی در حال طی شدن است. در نظام حقوقی داخلی، قانون تأمین اجتماعی مصوب 1354 به عنوان قانون حاکم بر شاغلین مشمول قانون کار، اغلب اتباع بیگانه شاغل در ایران را تحت شمول قرار می دهد لذا بررسی این قانون و مقررات مرتبط با آن می تواند میزان پایبندی به رویکرد حق محور به مقوله تأمین اجتماعی اتباع بیگانه در کشور را تا حدود زیادی تبیین نماید.Analysis and evaluation of the right-based approach to the social security right of foreigners in the Social Security Law

The process of guaranteeing the social security right of foreign nationals and protecting this right in the legal system; it is going at different speeds in different countries. Although some progress has been made in the legal system of our country; however, there are still significant legal challenges in the field of social security insurance for foreign nationals, which is the subject of the analysis of this article.
