چکیده
در تحقیق حاضر که به روش توصیفی – تحلیلی و با بهره گیری از منابع و متون کتابخانه ای وبا هدف «بررسی مسولیت ایالات متحده آمریکا ناشی از تحریم های اقتصادی ایران به انجام رسیده بر این اصل حقوقی استوار بوده که اگر دولتی در اثر رفتار خود موجب ورود خسارت به دیگر تابعان فعال حقوق بین الملل گردد یا یک تعهد بین المللی از سوی یکی از این تابعان نادیده انگاشته وموجب نقض یک تعهد بین المللی شود این تابعان با مطرح نمودن آن رفتارمی توانند مسئله مسئولیت و نقض یک تعهد بین المللی دولت وارد کننده خسارت را پیش بکشند. نتایج این تحقیق نشان می دهد که تحریم های یک جانبه دولت آمریکا علیه ایران به طور یک جانبه وخارج از قطعنامه ها و مقررات منشورسازمان ملل متحدوضع شده ومغایربا موازین حقوق بین المللی و حقوق بشری است، همچنین ناقض توافقات وتعهدات دوجانبه از جمله: عهدنامه مودت 1955، بیانیه الجزایر 1981و موافقتنامه برجام 2016 که موجب ورود خسارت های مادی و معنوی بر جمهوری اسلامی ایران شده و حق حیات و سلامت و بهداشت مردم و بیمارانی که در کشور ایران را نقض نموده و طبق اصول حقوقی ایالات متحده آمریکا مسئول جبران خسارات وارده می باشد.Investigating US Liability for Economic Sanctions on Iran

The results of this study show that the US government's unilateral sanctions against Iran have been unilaterally imposed outside the resolutions and regulations of the UN Charter and are contrary to international and human rights standards, as well as violating bilateral agreements and commitments, including the 1955 MOU. , The Algerian Declaration of 1981 and the Borjam Agreement 2016, which caused material and moral damage to the Islamic Republic of Iran and the right to life, health and well-being of the people and patients who violated Iran and is liable for damages under US law.
