چکیده
فقها بر اساس روایات، برای تربت حسینی احکام متعددی را بیان کرده اند. این پژوهش بر آن است تا با روش توصیفی تحلیلی پس از استقرا در تمام ابواب فقهی و تجمیع اهم مسائل این باب، دیدگاه فقها را در هر موضوع طرح، و با ذکر ادله هر مورد، ضمن تحلیل و بررسی آنها، دیدگاه صحیح را درباره هر یک از احکام این باب معرفی کند. یافته های پژوهش حاکی از آن است که تربت حسینی حرمتی اصیل در سنت نبوی داشته و بر اساس جعل الهی حائز خواص ویژه ای گشته و با انتساب به سیدالشهدا7 کسب شرافت نموده و بر این اساس واجد احکام استحبابی از جمله تحنیک هنگام ولادت تا حنوط هنگام مرگ شده و میان این دو زمان نیز احکامی چون استحباب سجده بر آن هنگام نماز و استشفا از بیماری با اکل از آن یافته است.The Analytical Assessment of Torbat Husseini Rulings
Jurists have issued many rulings about Torbat Husseini based on narrations. This descriptive-analytical research seeks to do induction in jurisprudential subjects, integrate the most significant relevant concerns, discuss the views of jurists on each subject, refer to the evidence of each case, analyze each case, and mention the proper viewpoint on each of the rules. According to the conclusions of the study, Torbat Husseini enjoys genuine respect in the prophetic tradition and has exceptional abilities based on the divine production. Being attributed to Sayyid al-Shuhadāʾ, this Torbat gains honor and accordingly acquires recommended rules such as ta ḥ n ī k at the time of birth and ḥ an ū t of the deceased one at the time of death. During the periods between these two, some rules are recommended to be followed, such as prostration on the Torbat at the time of prayer and eating it for healing from diseases.
