پیشینه و مبانی تشکیل پلیس قضایی در حقوق ایران (مقاله علمی وزارت علوم)

چکیده
اهمیّت چگونگی کشف جرم و تحقیقات پلیسی از یک سو به لزوم حفظ حقوق شهروندان و از سوی دیگر به لزوم عملکرد دقیق و سریع در این باره به منظورِ تأمین امنیت اجتماعی، باز می گردد. با وجود تقسیم بندی تخصصیِ نیروهای پلیس در برخی کشورها، در قانونگذاری ایران، این تقسیم بندی مورد نظر نبوده است. با این همه، مقررات قانون آیین دادرسی کیفری نو به ویژه ماده 30 آن به معیار های پلیس قضایی نزدیک شده است. آنچه از لزوم تشکیل پلیس قضایی مدنظر است، تحقق معیارهایی مشخص است که پلیس قضایی باید واجد آن باشد. قانون برنامه پنجم توسعه اقتصادی، اجتماعی و فرهنگی جمهوری اسلامی تشکیل پلیس قضایی را پیش بینی کرده است. پیرو قانون پیش گفته، لایحه تشکیل پلیس قضایی توسط قوه قضائیه به مجلس شورای اسلامی ارائه شد اما این لایحه تنها به تشکیل پلیس قضایی به عنوان یک سازمان جداگانهِ تحت اشراف قوه قضائیه اشاره نموده و به معیارهای بایسته تشکیل این نهاد توجه نداشته است. معیارهای لازم برای تشکیل پلیس قضایی که لزوم کارآزمودگی و توان تخصصی پلیس قضایی از طریق آموزش های مستمر و تحت اقتدار مقام قضایی بودن این نهاد است و از حیث سازمانی در قوه مجریه قرار می گیرد، در این مقاله مورد بحث قرار گرفته است.Background and Basis of the Constitution of the Judicial Police in Iran’s Legal System
The importance of crime detection and police investigation, on the one hand, derives from the necessity of protecting individual right and on the other hand, from the effective function of the police in order to protect social security. In spite of the specialized police division in some country, it has not been followed by criminal procedure law of Iran. After all, new enacted criminal procedure law, particularly article 30, somehow meets its criteria. In terms of establishing judicial police, regarding some certain criteria necessary for it, is intended. The fifth economic, social and cultural development program law of Islamic Republic of Iran provided its establishment; the judicial police establishment bill sent to parliament by judicial branch but the bill consider judicial police under the supervision of judicial branch and does not refer to the criteria. The criteria necessary for establishing judicial police, which are being specialized and under authorization of judicial authorities with organizationally establishing in the executive branch, would be discussed precisely in this article.
